June Court 1701 61 Which Jury being duly Tryed & Sworne and having heard ye Evidences & pleadings ye Court giveth them theire Charge who withdraw to consider on ye premisses & affter Some time doe againe returne and being Called over as alsoe ye Said Defendt. and being demanded whither ye Said Thomas Browne was Guilty as Indicted doe Say he is not Guilty & by William Glanvill all of them Say Therefore it is considered by ye Court here this Day vizt. ye 25. Day of June Annoq Domi. 1701 That ye Said Thomas Browne as to ye Said Indictment goe thereof without day he paying his fees Amounting to ye Sume of one Thousand forty & Six pounds of Tobo. Jno Dowdall Clk Affter which ye Said Thomas Browne by Michael Earle one of ye Attrys of this Court Moves ye Court that he may be Cleared by Proclamacon which was Granted Ordered Therefore that ye Said Thomas Browne be Cleared by Proclamacon which was done Accordingly Jno Dowdall Clk Leiut. Coll. Thomas Smith Sitts Danll. Perey being prsented by ye Grand Jury Last Court and ye Signed billa ye Said prsentment was framed into A bill of Indictment as followes Kent Ss The Jurors for our Soveraigne Lord ye King that now is for ye bodie of Kent County upon theire oathes doe prsent Daniel Perey for that he ye Said Danll. ye Twenty Second day of March Anno Domi. 1700 at Towne hundred in Kent County within ye jurisdiction of this Court by force & armes one horse of ye price of Three pounds Sterg. ye proper horse of A person unknowne felloniously did take and beare away agt. ye peace of our Soveraigne Lord ye King and agt. ye forme of ye Act of Assembly in that Case made & prvided Macklin pr Doms. Rege Not guilty pr patriam pr pr and he who followeth for our Lord ye King Sayes he is Guilty Macklin pr Doms. Rege Comand was Therefore given to ye Sherf. of Kent County that he cause to come here Twelve &a. by whom &a. who neither &a. To recognize &a. who made answer he had there ready Twelve &a. as by his precept he was Comanded vizt. William Glanvill Foreman John Ponder Christopher Pinder William Sigley Henry Gree[ne] Nathaniel Cleave Thomas Carman Patrick Bryan Thomas Hynes Thomas Ruth Thomas Ford and Thomas Smith which Jury being duly Sworne to Try ye Issue as above Joyned and having heard ye pledings & Evidences The Court giveth them theire Charge who withdraw to Consider on ye premises and affter Some time doe againe returne and being Called over as alsoe ye Said Defendt. and being demanded whither ye Said Defendt.
