June Court 1701 60 John Bennett having Entered into recognizance for his good behaviour & Appear :ance at Febry Court Last who Accordingly Appeared & entered into new recog :nizance with Suffitient Securitie for his Appearance at ye next Court & good behaviour in ye meane time who Accordingly entered into recognizance Att which next Court vizt. ye 25. Day of March Annoq Domi. 1701 ye Said John Bennett Appeares according to recognizance and ye Said John being presented by ye Grand jury ye Said Presentmt. was Signed billa vera & ye Said John Comitted to ye Sherf. Custody untill he find Securitie for his good behaviour & Appearance at ye at ye Next Court which prsentment was framed into A bill of Indictment as followeth vizt. Kent County Ss The Jurrors for our Soveraigne Lord that now is gor ye bodie of Kent County Upon theire oathes doe prsent John Bennett otherwise Called John Bennett of Kent County planter for that he ye Said John ye feare of God before his Eyes not having with force & armes ye Thirtieth Day of October Anno Domi. 1700 at Towne hundred in Kent County within ye Jurisdiction of this Court Sixteen yards of Linner four yards of frize three yards of Tape Twenty Skeines of Thread & Two Ells of houswives linnen of ye proper goods & Chattles of A Certaine John Offley of ye price of five hundred pounds of Tobo. felloniously ye Said John Bennett did Steale & beare away at. ye peace of our Lord ye King & ye forme of ye Act of Assembly in that Case made & provided Macklin pr Doms. Rege And ye Said John Bennett being demanded whither he was Guilty or not Guilty as he Stood Indicted Sayes he is not Guilty & for Tryall puts himselfe upon God & ye Country pr pr And he who followeth for our Lord ye King Sayes he is Guilty Macklin pr Doms. Rege Comand was Therefore given to ye Sherf. of Kent County that he cause to come here Twelve &a. by whom &a. who neither to recognize &a. who made answer he had there ready Twelve &a. as by his prcept he was Comanded vizt. Thomas Wyatt foreman Nicholas Massey Christopher Pinder Wm Sigley Henry Green Nathanll. Cleave Thomas Carman Thomas Hynes Thomas Ruth Thomas Ford Thomas Smith and John Ponder which Jury being duly Tryed & Sworne to Try ye Issue Joyned and having heard ye Evidences & pleadings on both Sides ye Court giveth them theire Charge who withdraw to Consider on ye prmisses and Affter Some time doe againe returne & being againe Called over as alsoe ye Said Defendt. and being demanded whither ye Said John Bennett was Guilty or not Guilty as presented doe Say he is not Guilty & by Thomas Wyatt theire foreman all of them Soe Say Therefore it is Considered by ye Court here vizt. ye 25 Day of June Annoq Domi. 1701 That ye Said John Bennett as to ye Said Indictment goe thereof without day paying his fees amounting to ye Sume of one Thousand Seaventy & four pound[s] of Tobo. Jno Dowdall Clk But ye Said John Bennett by Michael Earle one of ye Attrys of this Court moves ye Court that ye Said John may be Cleared by Proclamacon which was granted Ordered Therefore that ye Said John Bennett be Cleared by Proclamacon which was done Accordingly Jno Dowdall Clk Capt. John Whittington absents himselfe but returnes Suddainly |
