this Court ye Tenth day of Novemr. Anno Domi. 1700 ye feare of God before his Eyes not having but being of an Evill and wicked mind togeather wth. a Certaine Mary O誰eale did and as yet doth incontinently of Almighty God against ye peace of our Soveraigne Lord ye King and agt. ye forme of ye act of Assembly in that Case made & provided Macklin pr Domi. Rege Not Guilty pr patriam Earle pr Defendt. And he who follows for our Lord ye King Sayes he is Guilty Macklin pr Domi. Rege Comand was therefore given to ye Sherf. of Kent County that he cause to come here Twelve &a by whom &a. who neither &a. To recognize &a. which Said Sherf. made Answer he had there ready Twelve &a. as by his precept he was comanded vizt. Richd. Mason foreman Mathew Mason Thomas Carman Thomas Cooke Nathll. Cleave Richard Fillingham Thomas Browne Wm Robinson John Ponder Benjn Bond Charles Floyd and Jno Jhonson which jury being duly Tryed & Sworne to Try & Isue as above recited and having heard ye pleadings Evidences and Alegacons on both Sides ye Court giveth them theire Charge who withdraw to consider on ye prmisses and after Some time doe againe returne and being againe called over as alsoe ye Said Defendt. and being asked whither ye Said Defendt. was guilty as he Stands Indicted or not Guilty doe Say that he is Guilty and by Richd. Mason theire foreman all of them Soe Say Therefore it is considered by ye Court here that ye Said Thomas Tolley be fined ye Sume of Twenty Shillings and likewise pay ye Sume of one Thousand one hundred & Seaventy pounds of Tobo. cost accrewing upon ye Said Presentmt. & Indictmt. Jno Dowdall Clk Thomas Hawkins Jno Ponder Junr. and John Bennett all Sworne & Sent to ye Grand jury Coll. John Hynson & Mr. Phillip Hopkins both Sitts before ye above jury returne theire verdict Mr. Charles Hynson & Mr. Nathanll. Wright absent when ye verdict was returned Mr. Whittington likewise Sitts before verdict returned Richard Macklin Clk of ye Indictments moves ye Court that Neale O誰eale now prsent in Court may find Sufficient Security & enter into recognizance for his Appearance here at ye next Court as an Evidence on behalfe of his Majtie It was ordered that ye Said Neale [O綻Neale find Security for his Appearance here next court And ye Said Neale O誰eale Together wth. Coll. Hanse Hanson his Security comes into Court And ye Said Neale [O誰eale] doth Acknowledge himselfe to owe & Stand justly indebted unto our Soveraigne Lo[rd Kin]g Wm ye Third his heires & Successors &a. in ye full & just Sume Twenty pounds Sterg. to be leavied upon his Lands & Tenements goods & Chattles condiconed he make not his personall Appearance here at ye next Court & there to Serve as an evidence for his Majtie And ye Said Coll. Hanse Hanson doth acknowledge himselfe to owe & Stand justly indebted unto our Said Soveraigne Lord ye King his heires & Successors to be Leavied as Afsd. Condiconed as Afsd. wherewith they are Content John Jhonson Sworne and Sent to ye Grand jury |
