114 Novemr. Court 1701 Which next Court being an Adjourned Court all prcepts were contd in ye Sherf. Corrs & Constables hands untill ye 23d. day of Sepr. following Att which Said Court vizt. ye 23d. day of Sepr. Annoq Domi. 1701 ye day of ye returne of Said writt came Elias King high Sherf. of Said County & made returne thereof ~~~ vizt Cepi corpus pr Elias King Sherf And ye Said Plaintf by Richard Macklin his Attry moves ye Court that ye Said Defendt. Danll. Norris may conte in ye Sherf. Custody untill he find Espll. baile to Said Action which was by ye Court granted ~~~~ And Thereupon Ordered That Elias King high Sherf. of this County doe keepe in his Custody ye body of ye Said Defendt. Danll. Norris untill he find Espll. baile to ye Action depending between Edwd. Bathurst & ye Said Norris Jno Dowdall Clk And ye Said Defendt. was contd in ye Sherf. Custodie untill this prsent Court vizt. ye 28 day of Novemr. Anno Domi 1701 then came ye Said Defendt. Danll. Norris into open Court and brings Edward Plestoe his Security along with him who promiseth that ye Said Defendt. Shall pay condemnacon if cast or else he will doe it for him On which Said day ye Said Defendt. by Michael Earle his Attry Appeares & ye Said Cause Standing for Tryall ye Plaintf Decln Kent Ss Danll. Norris Stands Attached to answer unto Edward Bathurst of A plea of Trespass upon ye Case And whereupon ye Said Edward Bathurst by Richard Macklin his Attry complaines that whereas ye Said Edward Bathurst ye nineteenth day of Apll. Anno Domi. 1699. and cont. untill ye thirteenth day of Decemr. Anno Domi. 1700 Att Ceecill County within ye Jurisdiction of this Court at ye Spll. instance and request of ye Said Danll. had Sold & delivered unto ye Said Danll. divers goods wares & Merchandizes amounting to ye Sume of four thousand one hundred thirty & one pounds of Tobo. and alsoe at ye like Instance & request of ye Said Danll. in ye yeares Afsd. within ye Jurisdiction Afsd. had Creditted Severall persons with ye Sume of four hundred Sixty & nine pounds of Tobo. all which goods wares and Merchandizes Sold & delivered and Creditt to Sevll. persons as Afsd. Amounts in ye whole to ye Sume of four thousand Six hundred pounds of Tobo. as by an Acct. thereof to this Decln. Annexed and here in Court brought ye Same appeares In consideracon whereof ye Said Danll. upon himselfe Assumed and unto ye Said Edward then & there faithfully promised that he ye Said Danll. when thereunto Afterwards required ye Afsd. Sume of four thousand Six hundred pounds of Tobo. unto ye Said Edward would well & Truly Content & pay and altho ye Said Danll. hath paid and Satisfied unto ye Said Edward ye Sume of one Thousand five hundred Sixty & three pounds of Tobo. part of ye Said four Thousand Six hundred pounds of Tobo. yet as to ye residue thereof being three thousand Thirty and Seaven pounds of Tobo ye Said Danll. his promise and Assumption Afsd. little minding or regarding but plotting contriving and fraudulently intending him ye Said Edwd. in that behalfe crafftily & Subtilly to deceive and defraud ye Afsd. Sume of Three thousand Thirty & Seaven pounds of Tobo. unto ye Said Edward altho thereunto offten required hath not paid but ye Same to pay hath denyed & refused & Still doth deny & refuse & unjustly detaine to ye Damage of ye Said Edward Six thousand Seaventy & four pounds of Tobo. & thereupon he brings this Suite Macklin pr qr. pleadges Jno Doe &a. Richard Roe |
