311 Maryl.d fs On the 1.st Day of June 1770 Came before me one of the right honble the Lord Prop.y Justices of the Prov.l Court Thomas Jordan of the Kingdom of Great Britain Mariner one of the subscribing Witnesses to the within Power of Attorney and made Oath on the Holy Evangelists of Almighty God that he saw the within mentioned Thomas Philpot seal and deliver the within Power of Attorney as his ct and Deed and that Larkin Hammond the other subscribing Witness sign'd as a Witness thereto at the same Time Sworn before John Hepburn Recorded the 28.th Day of April 1772 Ex.d This Indenture made this first Day of March in the Year of our Lord one thousand seven hundred and seventy two Between John Hall (of Cranberry) in the County of Baltimore 7½ sides and Province of Maryland Gentleman of the one part and Benjamin Rumsey of same County and province Attorney at Law of the other Part witnesseth that it is covenanted concluded granted and agreed on by and between the Parties to these Presents and the saiD John Hall for himself his Heirs Executors and Administrators doth covenant grant and agree to and with the said Benjamin Rumsey and his Heirs by these Presents that he the said John Hall shall and will before the End of next April Provincial Term ensuing permitt and suffer the said Benjamin Rumsey to sue forth and prosecute against him the said John Hall one Writ of Entry upon a Disseisin en le post returnable before the Right Honourable the Lord Proprietarys Justices of the Provincial Court thereby demanding against the said ^John^ Hall all that Tract or Parcell of plantable Land called Cranbery Hall situate lying and being in Baltimore County aforesaid on the Eastern Branch of Bush River and Head of the said Branch containing one thousand five hundred and forty seven Acres of plantable land with all and every the Appurtenances by such Name and Names Number of Acres Quantities Qualities Terms and Descriptions in the said Writ to be contained and in such Manner and Form as by Councell learned in the Law shall be devised advised or required unto and upon which said Writ of Entry the said John Hall shall appear gratis and vouch to Warranty the common Vouchee who shall likewise appear gratis and enter freely into the Warranty and afterwards make Default and depart in Contempt of the Court so that Judgment maybe thereupon had and given for the said Benjamin Rumsey to recover the said Lands Tenements Hereditaments and Premisses against the said John Hall and for the said John Hall to recover over in Value against the Common Vouchee to the End that one perfect common Recovery with single Voucher may be thereupon had and suffered and all and every other Thing and Things be done and perfected needfull and convenient for the having and suffering the said Recovery according to the Course of Common Recoveries in such Cases used and the same Recovery also is to be executed by one Writ of habere facias Seisinam accordingly and it is further covenanted concluded granted and agreed by and between the Parties to these presents (the) |
