135 to and with the said Joshua Fraizer his Exors Admors and Assigns and every of them by these presents that he the said Daniel Dulany the hereby Bargained Premises and every part thereof against all and every Person and Persons claiming by from or under him Shall and Will warrant and for ever defend In Witness whereof the parties to these presents have Interchangeably Set their Hands and Seals hereto the Day and Year above written Signed Sealed and Delivered Signed Sealed and Delivered by Walter Dulany Jun.r in by Cornelius Garretson in Daniel Dulany Jun.r (seal) the presence of the presence of Tho.s Harwood 3.d Dan of S.t Tho.s Jenifer Corn.s Garretson (seal) Reuben Meriwether R Dobinson On the Back of the aforegoing Deed was Endorsed as follows to wit Received this 5th day of March 1771 of and from the within named Joshua Fraizer the Sum of Five Shillings Sterling Money being the Consideration within mentioned Witness Corn.s Garretson R Dobinson Received this 18th day of Sept.r 1770 of and from the within named Joshua Fraizer the sum of Thirty three pounds six Shillings and eight pence Sterling Money being the Consideration Money within mentioned Witness Tho.s Harwood 3.d Daniel Dulany Jun.r Maryland Ann Arundel County fs.t the 18 day of Sept 1770 Then came before me the Subscriber one of his Lordships Provincial Justices of the Coty afores.d the within named Daniel Dulany Jun.r and acknowledged the within Instrument of Writing to be his Act and Deed to and for the uses within mentioned W.m Hayward Maryland Ann Arundel Coty to wit March the 5th 1771 Came Cornelius Garretson before me the Subscriber and acknowledged the within Instrument of writing to be his Act and Deed for the Uses and Purposes therein mentioned Before 17¼ sides Recorded this 16th Day of March 1771 Dan of S.t Tho.s Jenifer X.d This Indenture made the 5th day of March Anno Domini Seventeen hundred and seventy ^one^ between Elie Vallette of the City of Annapolis of the one part and Robert Pinkney of the said City of the other part Witnesseth That the said Elie Vallette for and in consideration of the covenat hereafter mentioned Hath granted Aliened and Confirmed and by these presents Doth grant Alien and Confirm unto him the aforesaid Robert Pinkney all that parcel of Ground being part of said Elie Vallette's of the Lot N.o 50 in the City of Annapolis included within the following lines to wit Beginning at the end of fifty nine feet from the west corner of the Dwelling House of said Elie Vallette on a South 41° West course and running North thirty seven degrees thirty minutes West six feet then South 43° 45' West fifty one feet then South 33° East nine and a half foot and ^from^ thence to the beginning containing 449½ square feet To have and To hold the said premisses unto him the said Robert Pinkney his Heirs and Assigns forever And the said Robert Pinkney on his part for himself his Heirs Exors Admors and Assigns Doth hereby Covenat promise and agree that in Consideration of the above granted premisses he will not by himself or by any other person Build against the House of the said Elie Vallette or Errect any sort of works or Building whatsoever in his the said Robert Pinkneys yard or on any Part of the before mentioned Premisses which shall or may in any Manner of ways Obstruct the Light from or through the windows of said Elie Vallette on that part of said Elie Vallette's House facing his the said Robert Pinkney's yard or the Premisses aforesaid nor raise any Obstruction whatever Except the Liberty of lying one pile of wood along and (adjoining) |
