532 Containing two hundred and twenty Six Acres more or less and Other the Premisses with the Appurtenances unto him the said Jeremiah Magruder his heirs and Assigns against himself the said Thomas and his heirs and against all Other Person or Persons Whatsoever Claiming by from or Under him or them Shall and will warrant and for ever defend by these Presents In Witness whereof the Parties have hereunto interchangeably Sett their Hands and Seals the day and year first above written Signed Sealed and Delivered in the Presence of us Tho.s Rutland (Seal) the words (and his heirs) being first interlined Henry Hall Rob.t Couden On the Back of the aforegoing Deed was thus Indorsed to wit Received of the within named Jeremiah Magruder the Sum of five hundred Pounds Sterling being the Consideration within Mentioned to be by him Paid to me the day and year first within written Test Henry Hall Tho.s Rutland Rob.t Couden Aprill the 7.th 1769 Then came before us the Subscribers two of his Lordships Justices for Ann Arund.l County the within Named Thomas Rutland and Acknowledged the within Instrument ^of Writing^ to be his Act and Deed and the lands and Premisses therein Specifyed to be the Right and Estate of the within Named Jeremiah Magruder his heirs and Assigns according to the true Intent and Meaning thereof also Ann the wife of him the said Tho.s Rutland being by us Privately Examined apart from and out of the hearing of her said Husband and did Repeat as abovesaid and also declared that She hereby Released and Right or Title of Dower She might have in the said Land and that She made the acknowledgment of her Own free will & Accord without being induced thereto by threts or for fear of the Displeasure of Her said Husband agreeable to the Act of Assembly in such Cases made & Provided Henry Hall Rob.t Couden 1769 April 7.th Rec.d of M.r Jeremiah Magruder the Sum of Nine Shillings and One half Penny Sterling for the use of Lord Baltimore being the Alienation fine on the within Land & by Virtue of a Commission from Daniel of S.t Tho.s Jenifer Esq.r his said Lordship's Agent & Receiver General J Brice 10¾ Recorded the 7.th day of April 1769 Exam.d This Indenture Quadripartite made the fifth Day of December in the Year of our Lord One thousand Seven hundred and Sixty eight Between Daniel Dulany of the City of Annapolis Esquire of the first Part John Colegate eldest Son and Heir at Law of Richard Colegate (Late) |
