(454) Examd This Indenture Made this Twenty Sixth Day of September in the year of our Lord One thousand Seven Hundred and Sixty Eight Between Thomas Gist of Baltimore County in the Province of Maryland (Planter and Farmer of the one Part and Mordecai Gist of said County and Province (Merchant) of the other Part Witnesseth that the said Thomas Gist for and in Consideration of the Sum of Ten Pounds Sterling Money of Great Britain to him in hand Paid by the said Mordecai Gist the Receipt whereof he the said Thomas Gist doth hereby Acknowledge and thereby doth clearly Acquit and Discharge the said Mordecai Gist his Heirs Execr.s and Admr.s and by these Presents Hath given granted Bargained Sold Alilened Enfeoffed and Confirmed and by these Presents doth fully and Absolutely give grant Bargain Sell Alien Enfeoffe and confirm unto him the said Mordecai Gist all that Tract or Parcell of Land Called Friendship Lying and being in Baltimore County and Province aforesaid Begining at Two Bounded White Oaks and a Bounded Red Oak Standing on the side of a Ridge and on the West side of a draught of great Pipe Creek and Running thence South West Eighty Perches then North West Forty Perches then South West Eighty Perches then South East Eighty Perches then North Sixty three degrees East One hundred and Forty three Perches and thence with a Streight Line to the Begining Containing and Laid out for Eighty Acres More or Less to Have and to Hold the aforesaid Parcell of Land together with all Houses fences Buildings and all other their rights Members and Appurtenances unto the said Mordecai Gist his Heirs and Assigns and to the use and Behoof of sad Mordecai Gist his heirs and Assigns forever and also all the Right Title Property Interest Claim and Demand of him the said Thomas Gist in and to the same and the said Thomas Gist for himselfe and his Heirs doth Covenant and agree to and with the said Mordecai Gist his Heirs and Assigns that he the said Thomas Gist at the time of Ensealing hereof is & Stands Possessed and Premisses with all its rights, Titles, Priveliges, Members and Appurtenances and that the said Mordecai Gist and his Heirs shall and may from henceforth forever have hold Occupy and Possess and Enjoy the aforesaid Parcell of Land and Premisses together with its Appurtenances free and clear from let Suit Trouble denial Interuption or Molestation of him the said Thomas Gist his heirs Execr.s or Adm.rs and the said Thomas Gist for himselfe and his Heirs doth Covenant and agree to and with the said Mordecai Gist his heirs and Assigns that the said Bargained Land and Premisses with its Appurtenances is free and clear from all former and other Gifts, Grants, Bargains Sales or any other Incumberance whatsoever (the rents and Services hereafter due and Payable to the chief Lord of the Fee of whoom the Premisses are holden only Excepted) and so Shall be well and Sufficiently Warranted and defended unto the said Mordecai Gist his heirs Execr.s and Admr.s by the said Thomas Gist not only against the said Thomas Gist and his Heirs but against all and Every other Person or Persons that shall claim or Pretend to claim any right Title or Interest to the same by from through or under the said Thomas Gist or his Heirs or any of them Lastly the said Thomas Gist for himselfe and his Heirs doth further Covenant |
