(201) act and Deeds and the Lands and Premisses therein mentioned to be the right and Estate of the said Joseph Cowman and John Thomas according to the form and effect thereof and agreeable to the Act of Assembly in such case made and Provided Recorded the 20 May 1767 John Weems (Seal) Sides Elisha Harrison (seal) Exam.d This Indenture Tripartite made this tenth day of April in the Year Seventeen hundred and sixty seven Between Ralph Marlow of Prince Georges County Planter and Ann his wife of the one part John Marlow of the same County Planter of the second part and John Rogers of the same County of the third part Whereas for the docking barring and extinguishing all Estates Tail and Reversions and Remainders thereupon expectant and depending of and in the Land and Appurtenances herein after mentioned the said John Rogers as Demandant is hereafter at the request cost and charges of the aforesaid John Marlow to prosecute and sue forth out of his Lordships High Court of Chancery his said Lordships writ of Entry sur disseisin en le post against him the said John Marlow returnable and to be returned to the Provincial Court at Annapolis on the third Tuesday of May next whereby the said John Rogers is to demand against him the said John Marlow All that tract or parcell of Land called Wheeler's Hope lying in the county aforesaid and Beginning at a bounded white oak standing in the woods on the north side of a fresh run which runs into Piscattaway Creek near a great Beaver Damm Running thence north and by west one hundred and fifty perches to a bounded white Oak standing by a Small branch thence west and by South one hundred and fifty perches to a bounded white oak thence south west and by south one hundred and twenty perches to a bounded red oak upon a Hill thence west one hundred and eighty perches upon a Hill to a bounded white oak thence South South west one hundred and eighty perches to a bounded white oak standing by the said run thence running as the run runneth to the first bound tree containing and laid out for three hundred sixty and five acres of Land with the appurtenances thereto belonging To which said writ the said John Marlow shall and will appear in his proper person or by his attorney or attornies lawfully authorized and vouch to warranty thereof the aforesaid Ralph Marlow and Ann his wife who shall likewise appear gratis in their proper persons or by their attorney or attornies lawfully authorized and shall and will enter into the said warranty and vouch over to warrant the same premisses the common vouchee who shall thereupon appear and enter into the said warranty and after Imparlance make default and such further and other proceedings shall be therein so that one or more good and perfect common recovery or Recoveries with double voucher shall and may be had suffered perfected and executed in all things according |
