20) grant alien bargaine and Sell and Confirme unto him the sayd Charles his heires and assignes for ever all that tract or pcell of Land Called S.t Barberrys Lying in S.t Maries County near to Chesepeake bay Beginning at a marked white oake standing in the exteriour Line of W.m Guythers Land w.ch bounds upon Chesepeake bay part whereof is now in poss.n of W.m Taylard afd runing thence north west and by north two hundred ninty two perches to a bounded spanish oake of S.t Eliz.as Mannour thence north and by west two hundred & sixty perches to a bounded Red Oake thence east north east one hundred perches to a bounded white oake of Anthony Evans standing by Popes Hoggpen branch in the Exteriour Line of W.m Hawley Esq thence bounding upon the s.d Land to the first bounded tree Cont.a by Estimation two hund.d & fifty acres of Land more or Less Togeather w.th all and singular the houses building Edifices Fences Orchards gardens pastures & cornfeilds w.th all priviledges & apputts to the same Land belonging or in any wise appertaining Togeather also w.th a certaine Lot of Towne Land N.o 92 scituate & being the Citty and port of Annapolis afd in Prince Georges Street begining at a post in the Line of the s.d street it being a divideing post between him and Christopher Smith and runing w.th the s.d street north west one hundred forty & half foot thence south west two hundred sixty four foot to the south east then w.th the said Line South East one hund.d forty Eight foot then w.th a Straight Line to the first post Containing and Laid out for one hundred forty four square perches togeathe w.th y.e dwelling house and other outhouses garden and other the premises upon the afd Lot of Land lying and being and all other beneffitts and previledges to the same Lot of Land belonging or in any wise appertaining To have and to hold the afd two hund.d & Fifty acres of Land and the s.d Lott of Towne Land w.th all the Messuages Tenements house and premises thereon and on any part thereof errected and built Togeather w.th all and singular other the premises w.th the apputts before by these psents granted or meant menconed or intended to be granted bargained sold & confirmed w.th every of their appurtenances unto him the said Charles Carroll his heires and assignes for ever and to the only proper use and behoofe of him y.e s.d Charles Carroll his heires and assignes for evermore & to no other use intent or purpose whatsoever And the s.d W.m Taylard and Audry his wife for themselves their heires ex.rs and adm.rs Do hereby Covenant pmise and agree to and w.th the said Charles Carroll his heires and Assignes that the afd tract of Land and Lot of Ground w.th the houses and other y.e premises hereby granted bargained and sold are at the time of the ensealing & delivery of these presents free & clear of and from all manner of incumbrances whatsoever whither by statutes judgments recognizances or forfeitures of him the said W.m Taylard or the Lines and bounds thereof Runing into any other Lands or Lotts or by any other ways or meanes whatsoever saveing only for the Quitt Rents that shall hereafter become due to the Right hon.ble the Lord propry And the s.d W.m Taylard his heires ex.rs and adm.rs shall & will warrant & for ever (defend) |
