798 (779 Decemb.r y.e 14.th 1696 I Kenelm Cheseldyn doe depose upon my oath that haveing beene about three years Comissa.ry Gen.ll under his Ex.ncy Colonel Nicholson his Ma.ties p.rsent Govern.r of this Province of Maryland and alsoe one of y.e Masters in in Chancery for some time & one of his Maj.ties justices for S.t Marys County Court in y.e s.d Province that his Ex.ncy did never advise councill or by anyway or meanes influense me in any y.e s.d Offices to doe otherwise but what I was Oblidged by law and equity to doe & did allwayes advise me to Act therein according to y.e best of my skill & Knowledge in y.e same and further that he granted me y.e s.d places w.thout any consideracon given & believe y.e same was granted of his owne free will & by advice of y.e hono.ble y.e Councill of this Province; Jurat in Curea die & Anno supdic Kenelm Cheseldyn H Wriothesley Clk of y.e Prov.ll Court I Underwritten do Testifie that I have been some years in his Maj.ties service w.thin this Province as soll.r Gen.ll Und.r y.e p.rsent Govern.rs Conduct and his Comand and dureing that time I have been often Comanded to Attend his Ex.ncy but in all that time I can & doe say that his Ex.ncy never required Advised or Comanded me to prosecute or doe anything Contrary to or ag.t Law or ever comanded me to straine or urge any thing ag.st any man contrary to or beyond y.e Law but to y.e best of my remembrance hath constantly and at all times comaned me to proceed according to y.e Law but never as I know Urged me to anything beyond beyond what y.e Law warranted and to y.e best of my Knowledge I have not acted in y.e s.d service contrary to Law Jurat in Curea 12 Dec.rs 1696 H Wriothesley Clk Will.m Dent I John Freeman (who have beene for y.e space of two yeares and almost three months and am still Register of y.e high Court of Chancery for y.e Province of Maryland) doe upon my oath and with all sincerity testifie and declare that his Ex.ncy Francis Nicholson Esq.r Cap.t Gen.ll & Govern.r of this Province did Never directly nor indirectly (by any comand or any other meanes whatsoever) enjoyne or require me to act or doe any matter or thing contrary unto y .e ^any^ Law statute usage
or custome of England or of this province nor to us partiallity for or
ag.t any psonin any case comenced or depending in y.e s.d Court And in all doubtfull or difficult Cases wherein (by reason of y.e Absence of Chancellour or other psons principally concerned) I have been necessiated to request his Ex.ncys directions This only Answer have I allways recieved (to wit) that it was his pleasure & comand that I should consult y.e law and advise w.th y.e professors thereof and upon due Informacon act according to their Instructions and y.e decrees rules and Ord.rs of his Maj.ties high Court of Chancery without respect of psons or delay of Causes Nor doe I know or believe that his Ex.ncy ever recieved any gift whatsoever from any pson to confer any place or office or favour any cause nor doe I believe that any of his Ma.ties subjects in this Province have any cause to complaine ag.t his Ex.ncys Govern.mt To y.e truth whereof I do heartily subscribe Sworn Dec.r 14.th 1696 before y.e Prov.ll Justices in Open Court John Freeman Reg.r in Ch.ry at Annapolis H Wriothesley Clk I Underwritten doe swear that I have been imployed as Attorney Gen.ll of this Province und.r his Excell.ncy y.e p.rsent Govern.r ever since his Arrivall in y.e Province & that I never had any instructions or advise from his Ex.ncy dureing y.e time above s.d either directly or indirectly to prosecute any pson or Action ag.t them and that I never was asked for had or demanded of me any gratification or reward for my place of Attorney Gen.ll And I doe further declare upon my oath that being Collector and Reciever of Petuxent District I never was directed by his Ex.ncy the Govern.r to Advance or increase any Fees or Allowance for his Ex.ncys intrest more then y.e Law directed or to doe or act anything or things as Coll.r and reciever afores.d Contrary to y.e Law 12.th Dec.rs 1696 George Plater Then came y.e above named George Plater Esq.r and made oath upon y.e holy Evangelist that y.e contents aboves.d is the truth H Wriothesley Clk |
