748) 765 To the Cheife Lord or Lords of the Fee or Fees for or in respect of the aforementioned premisses allways Excepted and foreprized And the said W.m Smoote for himself his heires Ex.rs Adm.rs the said Tract of Land and all and singular other the premises before granted bargained and sould with theire and Every of theire Rights Members and Appurtenances unto the said Philip Lynes his heires and Assignes of him the said W.m Smoote his heires Ex.rs Adm.rs and ag.t all other psons whatsoever shall and will warrant and for ever defend by these p.rsents And further the said W.m Smoote for himself his heires Ex.rs & Adm.rs shall and will at any time within the space of seven years next ensuing the Date of these p.rsents at the reasonable request at the proper Cost and Charges in the Law of him the said Philip Lynes his heires or Assignes make signe seale Deliver & acknowledge any other Conveyance or conveyances Assurance or Assurances whatsoever are requisite in the Law for the more better assuring and firme Conveying the said Tract of Land and prmises under him the said Philip Lynes his heires or Assignes as by his or theire Councell learned in the Law shall be reasonably advised devised or required In Wittness whereof the partyes first above Named to these p.rsent Indentures have Interchangeably sett to theire hands & seales the day and year first above written Signed Sealed and Delivrd in W.m Smoott (seale) prescence of Deyzer Robert Barratt William Harbour Memorandum that the tenth Day of June in the Second Year of the Reigne of our Sovereigne Lord and Lady William and Mary King and Queen &c And in the Year of our Lord 1690 came into Court before their Maj.tys Justices for Charles County the within Named William Smoote one of the partyes to the within written Indenture and acknowledged the same to be his Act and Deed and Acknowledged the same to be his Act & Deed Right of the within mentioned Lands and premises to be the Right of the within Named Philip Lynes as those which the sd Philip Lynes hath of the guift of the said William Smoote and those he hath remised and quite Claimed from him and his heires to the said Philip Lynes and his heires for Ever And the said W.m Smoote hath granted for him and his heires that he will warrant to the said Philip Lynes and his heires the within Mentioned bargained premises with the appurtenances at him the s.d W.m Smoote and his heires and all other psons whatsoever And for which the s.d Philip Lynes hath given to the said W.m Smoote the sum of Five thousand pounds of Tobacco &c Record lib R fo 5 6 Know all men by these p.rsents that I William Smoote of Charles County planter did formerly sell and Receive of and from Philip Lynes of Charles County M.rcht full satisfaction for a Tract of Land lying at or near ould Roade Creeke in Baltemore County containing by Pattent Eleven hundred Acres as p the Pattent and Conveyance acknowledged to the said Lynes in Charles County Court more at large appears Now thus it is the Land lying in Baltemore County and that the Law doth oblige that all Lands sould shall be acknowledged & Recorded either in the Provinciall Court or in the County Court where the Land lyeth And that this said Land is only acknowledged in Charles County and there Recorded and Requires further Acknowledgment I doe hereby desire that this Conveyance may be Acknowledged and Recorded and all |
