728 (718 At the Court at Whitehall the 28.th of December 1693 Present The Kings most Excellent Maty in Councill The R.t Hon.ble the Lords of the Committee of Trade and Plantacons haveing humbly recommended Col Francis Nicholson to be Governor in Cheife of the Province of Maryland in the Place of Col Copley lately deceased His Ma.ty in Councill was this day pleased to Nominate the said Col Nicholson to be Governor in Chief of the said Province and to direct that the said Committee doe give Order for Preparing forthwith his Commission and Instructions accordingly W.m Bridgeman Maryland fs Know all men by these presents That I Henry Lowe of Calvert County in the Province of Maryland Gent am holden and firmely bound to the hon.ble Nicholas Sewall of Calvert County aforesaid Esq.r in the sume of Foureteene hundred pounds of lawfull money of England to be paid to the said Nicholas Sewall or his certaine Executors or assignes To which payment well & truely to be made I bind me my heires executors and adm.rs and every of us firmely by these presents sealed with my seale Dated the Eighteenth day of May for the yeare of our Lord one thousand six hundred Eighty & six Whereas there is a marriage intended by Gods grace shortly to be had & solempnized betweene the above bound Henry Lowe and Susanna Darnall of Calvert County Widdow the relict of John Darnall Esq.r decd with whome the said Henry is to receive as a marriage porcon a competent estate Aswell by setlement of land whereof she is seized in fee as of a personall Estate of which she is now possessed Now the Condicon of this obligacon is such That if the said Marriage shall take effect and the said Henry Lowe shall depart this life and lease the said Susanna his intended wife him surviving and shall before his death be legally invested in the lands of the said Susanna whereof she is now seized Then if the heires executors or administrators of the said Henry Lowe doe and shall well & truely pay or cause to be paid unto the said Susanna or he assignes the sume of seaven hundred pounds of lawfull money of England out of the Estate thereof within Twelve months after the death of him the said Henry and the other moytie thereof within Twelve months then next ensueing to be by her enjoyed as her owne proper estate free and discharged of all debts charges & encumbrances whatsoever which is intended and discharged declared to be in full of the dower tenements and hereditaments of the said Henry Lowe Then this present obligacon to be voyd & of none effect or else it to stand & abide in full force & vertue Sealed & delivered in the pnce of Henry Lowe us W.m Diggs Rich.d Keene Tho Grunwin |
