702 (692) of such Issue to the use & behoofe of Joseph Hopewell second son of the said Hugh & Ann & the heirs Males of his body lawfully to be begotten And for want of such Issue to the use of the heirs Females of the body of the said Joseph lawfully to be begotten And for want of such Issues to the use of Ann Susanna & Mary Hopewell Daughters of the said Hugh & Ann pty to these p.rsents & their heirs for ever equally to be divided amongst them And as to the other pcell of Land called Hogpen Neck to the use and behoofe of the said Agnes Jessupp & the heires of her body lawfully begotten or to be begotten and for want of such heirs to the use of the said Richard Hopewell & the heirs Mailes of his body lawfully to be begotten & for want of such Issue to to his Issue Female with other the Remainders over as in & by these p.rsents is before limitted & appointed touching & concerning the settling and entailing the above menconed two hundred Acres of Land aforesaid In testimony whereof the said ptyes have hereunto interchangeably sett too their hands & seales the day & year first above written signed sealed & delivered in the Ann A Hopewell p.rsence of us her mark George Plater Henry Loftus Richard Hopewell Record 22.o Dec.rs 1694 Maryland fs May the seventeenth in the sixth year of their Maj.tyes King William & Queene Mary's Reign came before us the within named Ann Hopewell of Calvert County widow & acknowledged the within to be her Act & Deed and that she did freely & voluntarily signe seale & Deliver the same for the uses designs intents & purposes therein menconed Nich Greenberry Thomas Tench Maryland fs Know all men by these p.rsents That I Ann Hopewell of Calvert County in the Province of Maryland widow am holden & firmly bound unto Richard Hopewell of the same County Planter for & on behalf of himself and his sisters Susanna Hopewell & Mary Hopewell three of the Children of Hugh Hopewell late of the same County planter decd by the said Ann his wife in the full & just sum of fifty Thousand pounds of good sound merchantable Tobacco & Caske to be payd to the said Richard Hopewell or to his certain Attorney his Exec.rs Adm.rs or Assignes To the which payment well and truly to be made & done I bind myself my heirs Exec.rs & Adm.rs in the whole & for the whole firmly by these p.rsents sealed with my seale & dated this Twelfth day of September in the year of our Lord One Thousand six hundred Ninety and Three The Condicon of this Obligacon is such that whereas the said Hugh Hopewell by his last Will & Testament bearing date the Three & Twentieth day of May Anno Dm 1687 after severall Legacyes thereby given & bequeathed did Give & bequeath to the said Ann his wife whom he made his whole & sole Executrix All his Lands which he was then possessed oft as alsoe all his Goods & Chattells |
