653) 663 five and Twentyeth day of December Dureing the aforesaid Terme of Foure score yeares if the same be lawfully demanded In Testemony whereof wee have caused the great Seale of our Province of Maryland to be affixed to these presents Dated at our City of S.t Marys the Tenth day of July in the Fifth yeare of our reigne &c Annoq.r Domini 1693 and Witness our trusty and Well beloved Nehemiah Blakiston Esq.r Keeper of the said Great Seale &c October the 4.th 1690 Sarah Benton Came and deposeth as followeth (viz.t) that a paper here produced under the hand of William Hawley is a Reall and true paper to the purport and intent therein conteyned she haveing from time to time safely Kept the same through severall diffulties and trouble John Coursey and William Luces was witness to the said deed and shee further deposeth that the said W.m Lucas had under s.d M.r Hawleys hand a paper to the selfe same purpose and effect that the aforesaid writeing was which she the deponant well knowes for that she heard the writeing Lucas had read Over and it is as for their particular lands the very same as her husband Cole had and further sayth that both these writeings for the land of s.d Cole & Lucas was done the same day and time and that quick after M.r Nicholas Guyther came the second time from England the said Lucas his house tooke fire and was burnt downe and as she very belives the said writeing burnt therein the said Lucas Making grate Complaint to this Deponant saying his writeings were burnt and that he had Nothing to shew for his land Butt did speake of getting Wittnesses sworne that Knew the matter well which witnessess to the best of this Depon.ts remembrance ware M.r John Coursey who writt the writeing produced M.r George Moathy M.r Thomas Williamson Andrew Warner and Coll Coursey & Maj.r Coursey And further sayth that the tobacco to be paid to M.r Hawley by Cole & Lucas which this Deponant Known for that M.r Nicholas Guyther Came to s.d Coles house to receive the Tobacco for the purchase and did receive the same and after went over a branch and her the Depon.ts husband Coming home againe she askt her husband how Lucas tobacco weighed he answeared it out weighed his but that was but part for Lucas purchase Yet this depon.t is well assured that the remaind.r was paid the same day at the house of Andrew Warner which her husband then plainely to his heires the deponant further saith that Andrew Warner paid two hodds of tobacco more in M.r Hawleys & Lucas Life time and further saith not Sworne before us the Day & yeare first above written John Dent Edward Greenhalgh And the 5.th day of October 1693 Came Coll Henry Coursey & deposeth that he Came over into this ^Country or^ province the yeare 1649 ab.t November and then tooke his habitacon at the house of George Mee at S.t Jeromes Creeke in S.t Marys County and then Cap.t W.m Hawley lived there & this deponants two brothers W.m and John also lived there and dureing the time of our liveing together which was about six months the said William Hawley sold severall parcell of land some to W.m Lucas and some to W.m Cole the said land all lying upon or at Least very neare S.t Clares Creeke and this deponant saith also that he is satisfyed the purchase was payd and he does veryly belive that he has heard Cap.t Hawley say that they had honestly payd him for the lands and further saith Not Jurat Coram me Henry Coursey Thomas Beech feb.ry Know all men by these presents that I Nicholas Guyther of S.t Jeromes doe by these p.rsents acknowledge to have received full satisfacon of W.m Lucas of S.t in the same County for a tract of land of foure hundred Acres formerly bought of Capt W.m Hawley as also I acknowledge have recd two hundred pounds of for a parcell of land bought of mee since as wittness my hand the day and yeare abovesaid Witness John Metcalfe Nicholas Guyther William Seely |
