605) 615 Twentieth part of the Gold and Silver ore (besides the said Fifth part to the use of his Maj.ty) as likewise one full Twentieth part of all the sd Gemms and precious stones quiksilver copper Tyn Lead mineralls mines mettalls and ores whatsoever that shall be found from time to time to be gained and got as afsd over and above all charges as afsd unto the sd Lord Baltemore his heires and Assignes to and for his and their owne use and benefitt and alsoe that he the sd Thomas Neale his Ex.rs Adm.rs and Assignes shall & will keep true and Faithfull accounts in writeing of all such Gold Silver Gemms and precious Stones Quicksilver Copper Tynn Lead Minerall mines mettalls and ores whatsoever that shall be found gained and taken up as afsd by force and vertue of these presents from time to time dureing the Terme of yeares hereby granted and (soe often as occasion shall require or that he or they shall be requested thereunto) shall and will produce permitt and allow the same accounts be inspected and Examined by the said Charles Lord Baltemore his heires or Assignes or by such other person or p.rsons as by him or them shall be impowered and Authorized in that behalfe Provided alwaies and It is the true intent and meaning of these p.rsents and of the sd parties and soe hereby declared to be that the sd Thomas Neale his Ex.rs Adm.rs or Assignes or his or Deputies agents workemen servants or other person or p.rsons by him or them to be imployed in and about the same within the space and time of Five yeares next ensueing the day of these p.rsents shall not open and worke one or more Mine or mines within the sd country province Collony or plantation or the Limitts thereof and alsoe Produce some Profitt and advantage to the said Charles Lord Baltemore his heires or assignes by and out of the same pursuant and according to the Reservacons and covenants afsd That then these p.rsents and therme and estate thereby granted and every clause matter & things therein Contained shall cease Determine and be Voyd anything herein contained to the contrary thereof in any wise notwithstanding And the sd Charles Lord Baltemore for himselfe his heires Ex.rs & Adm.rs Doth covenant and grant to and with the sd Thomas Neale his Ex.rs and Adm.rs by these p.rsents that he the sd Thomas Neale his Ex.rs Adm.rs & Assignes that at and under the Reservacons and covenants afsd shall and Lawfully may peaceably and quietly have hold use and enjoy all and every the Mines Mineralls Libertyes priviledges powers authorityes and other the p.rmisses whatsoever herein before menconed and intended to be hereby granted and take & receive the profitts benefits and advantage to arise or be made thereof dureing the terme hereby granted without any lett molestation interrupcon disturbance of or by the said Charles Lord Baltemore his heires Ex.rs Adm.rs or Assignes or any of them or of or by any other p.rson or p.rsons claimeing or to claime any right title or interest thereof by from or under him them or any of them the Rights Priviledges propertyes and estates heretofore by the sd Charles Lord Baltemore and Cecill late Lord Baltemore his late Father deceased or either of them respectively at any time heretofore made or granted unto the respective Inhabitants owners or proprietors of the sd Province Collony or plantation of Maryland and the Isles thereunto belonging Int.r 10.th March 1692 onely Excepted and foreprized In Witness whereof the party above Named to these p.rsent Indentures Interchangeably set theire hands and seales the day & yeare first above written C Baltemore (sealed) |
