608 (598 for ever the sd Francis Pennington for and in consideration of the sume of seaven thousand pounds of tobacco to him paid by the sd William Digges Hath given granted aliened bargained sold enfeoffed released & confirmed by Indenture of bargaine and sale under his hand and seale bearing date the 12.th day of October Anno Domini 1685 unto the sd William Digges his heires & Assignes for Ever all those two afsd Lotts or p.rcells of Land scituate Lyeing & being in the Towne and Port of S.t Maryes afsd Numbred (43) & (44) as aforesaid containing by Estimation two Acres of Land or thereabouts with all and singular the Lands Tenements houses buildings rights members and appurtenances to the same or any part or p.rcell thereof belonging or appertayneing To have & to hold the same to him the sd William Digges his heires & Assignes for ever And Whereas also the sd Francis Pennington by Indenture under his hand & seale bearing date the third day of March in the yeare of our Lord God 1686 for and in Consideration of the sume of three thousand pounds of Tobacco to him paid by the sd William Digges did given grant alien bargain sell enffeofe and confirm unto the sd W.m Digges his heires & Assignes for ever all that tract parcell or divident of land Lyeing & being in the Citty of S.t Maryes part of a greater tract of Land commonly called and knowne by the name of the priests Land begining at the Eastmost bounds of three acres of Land formerly belonging to Leonard Calvert Esq.r & since his death alienated to William Smith (the Land first above mentioned) runing South thirty six p.rches to the south side of a Branch called Chappell branch thence runing with the sd Branch Northwest & by West five degrees Westerly twelve p.rches thence North Northwest by the side of the sd Branch thirty four p.rches to the Beech by S.t Maryes River als S.t George River thence runing with the sd River North seaventeen p.rches to the sd three acres thence with the sd three acres fourty p.rches to the first bounds conteyning by Estimacon six acres More or less with all and every the Lands Tenements houses Edifices buildings orchards Gardens Easements or appurtenances whatsoever to the same or any part or p.rcell thereof belonging or appurteyning To have & to hold the same to him the sd William Digges his heires & Assignes for ever Now this Indenture further Witnesseth That the sd William Digges and Elizabeth his wife for the rents covenants and agreements hereafter mentioned and for ^divers^ other good causes and consideracons them thereunto doe demise grant and to farme lett unto the sd Lionell Copley Esq.r all the afsd first mentioned Two Messuges or Tenements with thand and app.rtences and to farme letten by the sd Garrett Vansweringen to the sd John Quigley and by the sd John Quigley to the sd Mark Cordea and by the sd Mark Cordea to the sd William Digges; As also all those other two Towne Lotts and six acres of land more herein before mentioned and expressed to be aliened bargained sold and Assigned over unto the sd William Digges by the sd Francis Pennington togeter with all and singular the Lands Tenem.ts huses edifices buildings orchard Gardens benefitts Easements Commodityes and appurtenances whatsoever to the same or any part thereof belonging or appurtaining To have & to hold the same and every part & p.rcell thereof to him the sd Lionell Copley Esq.r his Ex.rs Adm.rs and Assignes positively and absolutely certain for dureing and untill the full end and tearm of one and Thirty yeares first before mentioned from the commencement thereof shall be fully compleated and ended that is to say Five yeares from the 25.th day of September last then yett to come thereof and unexpired and in case the sd William & Elizabeth Digges or either of them their or either |
