606 (596 with other conditions covenants and provisoes in the sd Lett.rs Pattents mentioned as by the same remaineing upon Reccord in the same Province of Maryland relation being thereunto had may more at Large appear By vertue whereof the sd W.m Smith became possessed of the sd Land and thereon did erect and built divers houses and afterwards dyeing by his Last Will and Testament in writeing Legally proved constituted and appoint Mary his wife his whole & sole Executrix who afterwards Intermarryed with Daniell Jenifer of the Citty of S.t Maryes Gent and dyed Intestate And Whereas the sd Daniell became ^administrator^ legally of all & singul.r the goods & chattells of the sd William which were not administred by the sd Mary Ex.rx as afsd and thereby became also legally possessed of all and singular the p.rmisses He the sd Daniell on the seaventeenth day of December in the yeare of our Lord God 1672 by a certaine writeing under his hand and seale for a valuable consideration therein menconed to him paid did sell and make over the p.rmisses afsd with the appurtenances unto Garrett Vansweringen and John Quigley gent for the tearme afsd and whereas also the said John Quigley did assigne sell & make over unto the sd Garrett Vansweringen his Ex.rs Adm.rs or assignes all his the said Quigley right title and Interest of in and to the p.rmisses and every part and parcell thereof by Indenture of Assignement bearing date the 8.th day of February in the yeare of our Lord God 1672 And Whereas the said Garrett Vansweringen for and in consideration of the sume of Eighteen thous.d pounds of tobacco to him paid by the sd John Quigley did upon the sd 8.th day of February Anno Dm 1692 devise grant and to farme lett unto the sd Quigley his Ex.rs Adm.rs or Assignes all those two Messuages or Tenements being part of the p.rmissed afsd the one then in the tenure possession and occupation of Robert Ridgely and ther then in the tenure and possession of Robert Carvile together with all the ground within the payles from the Backside of the said house untill within twenty foote of the gutter before the Doore of the house wherein the sd Garrett then lived the Divisionall line to runn from the payles frounting toward the country house then in the possession of Richard Moy untill it comparallell with the Kitchin chimney then in the possession of M.r John Moorcraft and soe with a straight lyne to the sd kitchin cheminey To have & to hold the sd Tenements & p.rmisses part of the sd first demised p.rmisses to him the sd John Quigley his Ex.rs Adm.rs & Assignes untill the end of the tearme afsd granted by the sd Lord Baltemore to the sd William Smith Yelding and paying therefore yearely unto the sd Garret his Ex.rs Adm.rs or assignes at the house whereof he then Lived one Fatt capon at or upon the Feast of the birth of the our Lord in every respective yeare if Demanded And Whereas also the sd John Quigley for and in Consideration of the sume of sixteen thousand pounds of tobacco to him paid by Marke Cordea Gent hath assigned his Right & title of in and to the sd two Messuages or Tenements with the appurtenances for and dureing the remaind.r of the sd terme of one & thirty yeares then to Come and unexpired in the p.rmisses to the sd Marke Cordea his Ex.rs Adm.rs or Assignes as by endorsement of William Calvert the attorney of the sd John Quigley under his hand and seale bearing date the 29.th day of July Anno Dm 1673 on the back of the sd Indenture of assignement from the sd Garrett to the sd John Quigley doth & may apear And Whereas |
