59 Every such further act and acts thing and things assureances and Covance in the Law whatsoever for the further more better and perfect assureances and shure makeing of the shuremakeing the said Parcell of Land houses and all that the Premisses with appurtenance above by these presents mentioned to be bargained and sold unto the said John Addison his heyres or assignes for ever by fine or fines Recovery or Recoveries the Enrowlment or acknowledgments of these presents release confirmation with warranty against the said Jona.than Clarke and Phillip Lewen their heyrs Executors &.ca or without Warranty or by all Any or as many of the ways meanes and devices aforesaid or by any other ways or meanes whatsoever as by the said John Addison his heyrs or any of their heyrs or assignes or by their or either of their Councell Learned in the Law shalbe Reasonable devised or advised and Required In Wittness whereof the partyes above named have to this present Indenture sett their hands and seales the day and yeare above written the marke of the mark of the marke of Jonathan Clarke sealed Rebecca T Clarke sealed Phillip P Ί Lewen Margarett B Lewen sealed sealed on the backside of the aforegoing Deed was thus written viz.t The within written Indenture was the said Thirteenth day of Aprill Anno One Thousand six hundred seventy Eight signed sealed and delivered by the said Johnathan Clarke Phillip Lewen and their Wives in the Presence of Thomas Innes Francis Hill John Blomfeild Aprill the 13.th 1678 The within written Deed was then in Open Court by the within named Jonathan Clarke & Phillip Lewen acknowledged to be their Act and deed to the uses therein mentioned And Rebecca and Margarett the wives of the said Jonathan & Phillip being privately Examined acknowledged that they gave their free Consents to the sale of the within mentioned premisses with ^out^ the Coertion or Compulsion of their Said Husbands Nic Painter Cl Cur Provinciall I Richard Windall of Liverpoole Merriner doe hereby engage & binde my selfe my heyres Ex.rs & Adm.rs never to take any advantage against Marke Cordea & John Addison Merchants their Facto.rs assignes or goods upon the breach of a Charter party of fraightment between me the said Richard for the one part & the said Marke & John of the other part for hire of the Shipp Liverpoole Merchant from England to Ireland to this Province & for backe for England againe which said Ship was in this Province of Maryland condemned for breach of an Act of Parliament & Repurchased by me by the assistance of the said Merchants therefore I doe wholy for my selfe & partners owners of the said ship release & discharge the said Marke Cordea & John Addison their heyres & Assignes goods & Chattells from my damage trouble or Charge by them to be sustained or accrued by breach of the said Charter party on their part by being the cause of the Condemnacon of the said Ship by Shipping on board her prohibited goods only they paying me freight according to agreement in the said Charter party And further I the said Richard doe Engage that the Condemnacon shall not Cutt any of the Seamen of the said Ship of any of their wages but the same is to be paid in such manner as if the said Condemnacon had never hapned Wittnes my hand & seale this Sixth day of June one thousand Six hundred seaventy eight Richard Windall Sealed Signed Sealed & Delivered in the p.rsence of Willm Wright Tho Copley Christo Aglionby Thomas Copley made oath that he sawe Richard Windall signe seale & deliver this as his act & deed Juravit the Seaventh day of May June one thousand Six hundred Seaventy eight Philip Calvert Bee it knowne unto all men by these p.rsents That I Mathew Merriton Citizen & saller of London doe hereby Assigne Authorize make depute appoint & constitute my loveing freind Thomas Smithson of London Merchant my true & lawfull Authority for me & in my name & stead & to my use to aske demand sue for levy recover & receive of & from Henry Parker of Talbott County in the Province of Maryland in the parts byond the seas Planter & of & from all & every or any person or persons whatsoever att Maryland aforesaid Respectfully All & every or any such debts dutyes sume & sumes of money whatsoever & other things as are due oweing comeing payable or belonging to me Either by land bill booke [illegible] or by any other wayes or meanes whatsoever And to obtaine & take possession of all or any Plantacon or other [illegible] mortgaged Jury said Attorney shall thinke fitt giving & granted my said Attorney my full power & Authority [illegible] Lawfull wayes & meanes to Act & doe in & touching the p.rmisses or any part thereof by course of law or [illegible] he shall thinke fitting And to discharge or give acquitances for what shalbe by him Received And [illegible] |
