563) 573 This Ind.r made the Tenth day of February One thousand six hundred Ninety and one Betweene Anthony Evans of S.t Maries County Gent and Jane his wife late wife of Henry Elliot late of the said County Gent decd of the one part and John Evans of the said County Gent of the other part Witnesseth That for and in Consideracon of the sume of Five shillings sterl in hand payd by the said John unto the said Anthony & Jane his wife The receipt whereof the said Anthony & Jane doe hereby acknowledge and thereof and of every part thereof doe exonerate acquite & discharge the said John his Executors & adm.rs & therewith doe hold themselves fully satisfied and content They the said Anthony & Jane Have given grannted aliened bargained and sold and by these presents doe give grannt alien bargaine & sell unto the sd John Evans his heires and assignes for ever All that tract or parcell of land called Brushy neck in S.t Maries County Begining at popes Hogpen Maine Run and runing up the maine branch joyning upon the land now or late in the possession of Nicholas Gwyther soe farr as the said branch runs in to the woods and from popes hog pen up the bay to the land of Stemhope Roberts called Drapers neck and from the head of popes hogpen run with a line drawne North on the north of Brushy neck to Stanhope Roberts land Being part of Five thousand seaven hundred acres formerly grannted unto William Hawley Esq.r deceased and decreed unto William Gwyther of S.t Maries County Gent his heires and assignes for ever By a decree out of the high Court of Channcery of this province which said tract called Brushy neck as aforesaid was afterwards purchased by one John Halfehead of S.t Maries County Gent to him and his heires for ever form the said William Gwyther and afterwards upon the death of the said John Halfehead without heire Escheated unto the Right hon.ble Charles Lord Baltemore proprietary of this province as by a certaine Inquisition indented bearing date the 12.th day of August An.o Dm 1678 relation being thereunto had it doth and may appeare And afterwards by Letters Patents under the great seale of this province bearing date the 30.th day of May 1679 for the causes reasons and Consideracons therein menconed grannted unto Henry Elliot late of S.t Maries County Gent decd & Jane his wife now party to these presents their heires and assignes for ever and now vested in the said Jane by survivourship Conteyning by Estimacon Three hundred acres as by Certificate of Survey of the said 5700 Acres menconeth Be it more or lesse To have & to hold all and singuler the afores.d Tract or parcell of land & premisses together with all houses outhouses tobacco house orchards gardens and plantacons with all & singuler the appurtennces thereunto belonging or in any wise apperteyning To him the said John Evans his heires and assignes for ever To the uses intents and purposes herein after menconed & expressed and to none other use intent or nor purpose whatsoever That is to say To the use of the said Anthony and Jane his wife during their ntall lives The remainder to the use of the said Anthony and his heires and assignes for ever And to noe other use intent nor purpose whatsoever In Witnes whereof the said Anthony and Jane have hereunto put their hands & seales the day and yeare first above written Anthony Evans (sigil) Jane X Evans (sigil) Sealed signed & delivered in the p.rsence her marke of Geo Butler Philip Clarke Tho Grunwin M.d this 26.th day of March 1692 before us underwritten Two of his Ma.ties Justices of the County Court of S.t Maries County Came the within named Anthony Evans & Jane his wife and acknowledged the within Indenture to be their Act & deed And the said Jane being by us solely & secretly Examined did freely declare that she did the same freely & voluntarily without threats or compulcon of her sd husband witnes our hands Rob.t Mason Edw.d Greenhalgh Recorded the 13.th Aprill 1692 |
