504 (494 Charles Absolute Lord & Prop.ry of the Provinces of Maryland & Avalon Lord Baron of Baltemore &c.a To the Hon.ble William Joseph Esq.r Coll Henry Darnall Coll William Digges Majo.r Nicholas Sewall & Clement Hill Esq.r Greeting Whereas it is suggested unto us by M.r Thomas Davis Merchant that Edward Carleton & Dudley Carleton of London Merchants have heretofore sent over divers Goods & Merchandizes into this Province Consigned to Basill Warren late of Calvert County deceased and were by him Received in his life time And that returnes are wanting to be made for the said Goods & Merchandizes sent as aforesaid and the ship or ships are now come into receive the same being willing that speedy Justice and right may be done aswell to the said Merchants in London as to the Estate of the said Basill Warren Deceased And that noe prejudice may be done to Either by Delatory proceedings at the speciall instance & request of the said Thomas Davis Have deputed Appointed Constituted and Ordained And by these Presents doe Depute Appoint Constitute and Ordaine You the said William Joseph Henry Darnall William Digges Nicholas Sewall & Clement Hill or any three of you whereof the said William Joseph & Henry Darnall to be two To be Judges of a speciall Court of Oyer and Terminer for the heareing stateing Ending and Determining of all affaires matters dealings Merchandizings & all diferences Claymes suites and Demands whatsoever relateing or in any wayes concerning any Goods wares or Merchandizes sent or Consigned by the said Edward & Dudley Carleton or Either of them to the said Basill Warren deceased or relateing or any wayes concerning the Returnes that have or ought to have been made to the said Carletons in Respect of the Consignement made as aforesaid And to Issue out writt or writts sup.a or sup.as Execucon or Execucons or other Process or Porcesses touching or Concerning the Premisses And also against all pson or psons whatsoever who are or shall be concerned or knowing in the Premisses that they and Every of them appe.r before you at such time or place as in the same Process shall be menconed And also to call before you all such pson or psons whatsoever whom you shall think fitt And to cause to be brought before you all writeings Letters Bookes Bills Bonds Papers and all other things whatsoever Concerning the Premisses And peruse view & look over the same or any or Either of them and to Issue out venire or veines to sumons Jury or Juryes in the aforesaid Premisses And to sweare the Jurors Evidences or others And haveing heard the whole matter alleadged before you And the prooffs Evidences and Testimonyes on both sides and the Verdict or Verdicts of the Jurors (if any be) Then to give your full and finall Determinacon in the Premisses as to you in your prudent understandings shall seeme meete and just And all other matters & things in the Premisses to doe Execute & Pforme as fully firmely & Effectually as well or Our Provinciall Court may or can doe in such like cases And the said Judges or any Three of them as aforesaid is hereby Authorized and Impowered from time to time to Adjourne the said speciall Court till the said business be |
