298) 302 All and singular the aforementioned to be hereby bargained premisses with the appurtenances and Every part and parcell of them and Every of them unto the said Giles Yallopp his heires and assigness to and for his and their owne proper use and behoofe as aforesaid from and against them the said Nicholas Nicholson and Hester his wife and Either of them and Either of their heires Executors administrators and assigness and from and against all and Every other person and persons Lawfully Clayming or to Clayme by from or under them the said Nicholas Nicholson and Hester his wife and by from or under any other person or persons whatsoever shall and will warrant and for Ever defend by these presents And the said Nicholas Nicholson and Hester his wife for themselves their heires Executors adm.rs and Assigness and for Every of them doth Covenant promise and Grant to and with the said Giles Yallopp his heires and assigness by these presents that they the said Nicholas Nicholson and Hester his wife at the time of the Ensealing and delivery of these presents stand and are or one of them standeth and is Lawfully seized of and in the said parcell of Land and all and singular other the said premissess with the appurtenances of a good sure Rightfull perfect Lawfull and Indefeizable Estate of Inheretance in fee simple without any Condition Mortgage or Limetations of any use or uses or pouer or Revocation of any matter or thing whatsoever which shall or may any way alter Change Charge or determine the same And alsoe that they the said Nicholas Nicholson and Hester his wife at the time of the Ensealing and delivery of these presents have or one of them hath full pouer good Right and Lawfull Authority to give grant aliene bargaine sell Enfeoffe and Confirme the said parcell of Land and all and singular the said premisses with the appurtenances to the said Giles Yallopp his heires and assignes in manner and forme aforesaid and according to the true Intent and meaning before Exprest And alsoe that the said Giles Yallopp his heires and assigness and Every of them shall and may from time to time and at all times forever hereafter Lawfully peaceably and quietly have hold use occupy possess and Enjoy the said parcell of Land and all and singuler other the said premisses abovementioned to be hereby given Granted aliened Bargained sold Enfeoffed and Confirmed as aforesaid and Every part and parcell of them and Every of them with the appurtenances without any Lett trouble suite Eviccon Mollestation deniall disturbance or Interruption of them the said Nicholas Nicholson and Hester his wife or Either of them or by reference a proper person or persons whatsoever Either of their heires Exers admin.rs or assignes or any other person or persons whatsoever And that free Clear and Clearly acquitted discharged saved harmeles and kept Indempnified of and from all and singullar former and other bargaines sales guifts grants leases Joyntures Dowres uses wills fynes Issue Intayles Mortgages Annutyes Rents arrearages of Rents Statutes Recognizances Judgements Extents Executiones debts Amercements Trusts orders decrees and of and from all other Estates titles troubles Charges and Incumbrances whatsoever had made Comitted suffred done by the said Nicholas Nicholson and Hester his wife or either of them or by and from any other person or persons whatsoever any of them Except the Rents and services which hereafter shall grow due unto the Cheif Lord or Lord of the Fee or Fees of the premisses for or in Respect of his or their seigneiory or signiorys onely and alwaies Excepted And further that the said Nicholas Nicholson and Hester his wife and Either of them their and Either of their heires Exec Adm.rs and assignes or any other person or persons whatsoever haveing or pretending to have any Estate or Interest in or to the said parcell of Land and p.rmisses or part thereof by from or under the said Nicholas Nicholson and Hester his wife or by from or under any other person or persons whatsoever shall and will at all time and times hereafter at and upon the Reasonable Request and at the Costs and Charges in the Law of the said Giles Yallopp his heires Exers adm.rs and assigness do make acknowledge Execute or cause to be made done acknowledged & Executed all and Every act and acts thing and things device and devices assureance and Assurances in the Law whatsoever for the further better and more perfect assuring and suremakeing and Conveying of the said parcell of Land and all other the premiss aforesaid With thappurtenances to the said Giles Yallopp his heires and assigness to the only proper use and behoofe of the said Giles Yallopp his heires and assigness for Ever by such wayes and means and in such manner and forme as by the said Giles Yallopp his heires or assignes or any of their Councill Learned in the Law shall be Reasonably devised advised or required In wittness whereof The partyes first
