299 (290 Or Convenient as fully and Effectualy as I my selfe might or could doe personaly Hereby Ratifeing and Confirming all and whatsoever my said Attorny his substitutes or assignes or any of them shall Lawfully doe or cause to be done in or about the premisses by vertue of these presents In witness whereof I the said Francis Hill have hereunto put my hand and seale the Eight and Twentieth day of November Anno Domj 1676 and in the Eighth and Twentieth year of the Reign of our Soveraign Lord King Charles the second &c Francis Hill Sealed subscribed & delivred in the presence of Nico Lowe Nicholas Sewall Recorded the 15.th day of Aprill 1684 P Tho Grunwin Clk John Body This Indenture made the sixth day of December Anno Domj One Thousand six hundred Eighty Three Between John Evans of Calvert County in the Province of Maryland Carpenter of the one part and Thomas Smith of the County and Province aforesaid Carpenter of the other part Whereas Robert Wright of the said County Planter by Letters Pattents under the great seale of the said province bearing date the foure and Twentieth day of Aprill in the five and Thirtieth year of the Dominion of the Ry.t hono.ble Cecilius &c the then lord prop.ry &c Annoq Dom 1667 had granted unto him a parcell of Land for one hundred and Fifty acres called Wrights Guift scituate Butted and Bounded as in the said pattent is Exprest all whose Rights title and Intrest of in and to the said Land He the said Robert Wright by a Certaine Conveyance or writting under his hand and seale and duely Entred upon Record in the provinciall Court of the said Province Assigned and made over unto the said John Evans his heires and Assigness for Ever as by the said Pattent and Conveyance Relation being thereunto had may more at Large appeare Now this Indenture wittnesseth that the said John Evans for and in Consideration of the sum of Foure Thousand pounds of Tobacco to him paied or secured to be paied the Receipt whereof and from the said Thomas Smith hee doth hereby acknowledge and thereof and from Every part thereof doth acquitt the said Thomas Smith for Ever by these presents hath granted Bargained and sold and by these presents doth Cleerly and absolutely Grant Bargaine and sell unto him the said Thomas Smith his heires and assigness for Ever all that aforementioned Tract of One hundred and Fifty acres of Land called Wrights Guift with all and singular the Rights members and appurtenances thereunto belonging or in any waise appertaining together with all deeds Evidences & writtings any waies touching & concerning the same or any part or parcell thereof To have & to hold the said one hundred and Fifty acres of Land and all other the premissess with the appurtenances to him the said Thomas Smith his heires and Assigness for Ever And the said John Evans for himself his heires Executors & Administrators doth hereby Covenant and grant to and with the said Thomas Smith his Excs Administrators and Assigness to Warrant and defend the said Bargained premisses of and from all Claimers whatsoever And the said John Evans his heires Exrs & Administrators will make performe and Execute from time to time such further and other act Deed Writting and Conveyance or assureance in the Law for the further Conveing and assureing the said Land unto the said Thomas Smith his heires and Assignes as the Law shall Require and Lastly that he the said John Evans hath good Right and full power at the sealing hereof to sell and dispose of the said premisses to him the said Thomas Smith his heires and assignes as aforesaid In wittness whereof the said John Evans hath to this present Indenture of Bargaine and sale sell his hand and seale the day and year first abovewritten Signed sealed and delivred and full possession of the abovementioned John Evans (sealed) premisses given by Turffe & Twigg In the presence of us John Woodward The mark of E George Enoc The mark of M Elizabeth White May 26.th 1684 Memorandum the day and year aforesaid came before us the within named John Evans and Sarah his wife and shee the said Sara being privately Examened by us out of the hearing of her said Husband did acknowledge that without any Threats or by Compulsion she gave her Free consent to the sale of the within mentioned Land Wittness our hands the day and year first abovewritten The said John Evans alsoe did acknowledge the within writting to be his act and deed as wittness our hands the day and year above written Henry Darnall May the 26.th 1684 Received the Alienation of the within Land P me Henry Darnall Colr John Darnall Recorded the 27.th day of May Annoq Dm 1684 P Tho Grunwin Clk |
