215 206 And by the said Will hee did amongst other things Impower his said Executrix to Confirme the sale of the said land w.ch hee had Sold to the said Rider her paying the Tobacco for the same as by the said Will bearing date the thirteenth day of November Anno Domini One thousand six hundred seaventy five may appeare In pursuance of w.ch said Will the said Frances in Consideracon of the sume of seaven Thousand pounds of Tobacco (being the sume greed betweene the said Lucas and the said Rider to be paid for the purchasing the said Land) to her well and truely paid by the said Rider Did by her Indenture bearing date the Fifth day of November Annoq Dom One thousand six hundred seaventy seaven Cleerely and absolutely give bargaine & sell and confirme unto the said Henry Rider and his heires for ever the said parcell of Land with the appurtenances thereunto belonging, And the said Henry Rider did upon the same day by his writeing under his hand and seale endorsed on the same Indenture sell assigne and sett over for the like Consideracon unto the said Robert Carvile the said Indenture to him the said Robert Carvile his heires and assignes for ever, But before the said Indenture and assignment aforesaid were acknowledged to be Recorded according to Law hee the said Henry Rider departed this Province Now this Indenture Further witnesseth that the above named William Holmes & Frances his wife for the better and more sure makeing settling and estateing the said parcell of Land unto the said Robert Carvile & his heires For ever according to the said assignment from the said Rider and the said Deede made to the said Rider from the said Frances pursuant to the will of the said Lucas Did by their Indenture bearing date the Tenth day of July One thousand six hundred Eighty one for the consideracons therein Mentioned bargaine sell release and Confirme unto the said Robert Carvile and his heires for ever the before mentioned parcell of Land Now this Indenture witnesseth that the said Robert Carvile for & in Consideracon of the sume of Eight thousand pounds of good sound Marchantable leafe Tobacco in Casq To be paid by the William Holmes his heires Executo.rs or Adm.rs to the said Robert Carvile his Executo.rs Adm.rs or assignes in manner following Viz Two thousand pounds of Tobacco upon the First day of January wch shall be in the yeare of our Lord One thousand six hundred Eighty Two and the like sume of Two thousand pounds of Tobacco upon the First day January w.ch shall be in the yeare of our Lord One thousand six hundred eighty three and the like sume of Two thousand pounds of Tobacco wch shall be in the yeare of our Lord one Thousand six hundred Eighty and foure & the like sume of Two thousand pounds of Tobacco Upon the First day of January One thousand six hundred Eighty five Hath given granted bargained sold Released and Confirmed unto the said William Holmes & Doth by these p.rsents give grant bargaine sell release and Confirme unto the said William Holmes and his heires forever All that the before menconed parcell of Land Lyeing and being upon S.t Clares Creeke in St Jeromes bounding on the Creeks side north by a marked oake & south by a marked Pohiccory being part of the said Lucas his Land whereon hee dwelt and by him laid out and bounded in his lifetime w.th all pffitts & appurtenances whatsoever to the same belonging To have & to hold the said parcell of land before by these presents mentioned to be bargained & sold to him the said William Holmes his heires and assignes forever Free and cleere and Absolutely acquitted and discharged of all manner of Former and other Bargaines sales guifts grants Judgments titles troubles & incumbrances whatsoever done by the said Robert Carvile or any Claimeing by from or under him And the said Robert Carvile for himself his heires Executo.rs and Administrators doth Covenant and agree to and with the said William Holmes his heires Executo.rs and Adm.rs that hee the said William Holmes his heires & assignes shall and may from time to time and at all times hereafter peaceably and Quietly hold and Enjoy the said Lands and premisses without the Lett suite or interruption of him the said Robert Carvile or any other person or persons Claimeing by from or under him them or any of them Provided Alwayes and Itt is [illegible] agreed on and Concluded by and betweene the partyes to these (Presents |
