195 (186 This Indenture made the Fifteenth day of June in the Fifth yeare of the Dominion of the Right honoble Charles absolute Lord and Prop.ry of the Provinces of Maryland and Avalon Lord Baron of Baltemore &c and in the yeare of our Lord one thousand six hundred Seaventy Nine Between John Edmondson of Talbott County merchant of the one part and Nicholas Painter of Calvert County Gent of the other part Witnesseth that the said John Edmondson for and in Consideracon of the sume of Five thousand pounds of Tobacco to him in hand paid by the said Nicholas Painter before the ensealing and delivery of these p.rsents the Receipt whereof the said John Edmondson doth hereby acknowledge and thereof and of every part and parcell thereof doth clearly acquitt and discharge the said Nicholas Painter the Exec.rs and Adminsts by these p.rsents Hath Given granted bargained sold enfeoffed and confirmed And by these p.rsents doth give grants bargaine sell enfeoffe and confirme unto the said Nicholas Painter his heires and Assignes for ever all that parcell of land called Broad Neck lying in Talbott County on the North side of Chester RIver in a Creeke called Edmonds Creeke and adjoyning to a parcell of land layd out for John Morgan called Hopewell Begining att the Northmost bound oake of the said land and runing for breadth North up the Creeke Three hundred and Fifty perches to another marked oake bounded on the North by a line drawn west from the said Oake Three hundred and Twenty perches on the west by a line drawne south from the end of the West lyne Three hundred and Fifty perches untill it intersect a parralel w.th the said land called Hopewell on the South by the said land on the East by the said Creeke containing by estimacon Seaven hundred Acres more or lesse Together with all Rights proffitts benefitts and appurtenances whatsoever thereunto belonging To have and to hold the same with the appurtenances unto the said Nicholas Painter his heires and Assignes to his and theire owne proper use and behoofe for Ever And the said John Edmondson doth hereby for himself his heires Executo.rs and Adminstrs Covenant promise and grant to and with the said Nicholas Painter his heires and Assignes by these p.rsents that hee the said Nicholas Painter his heires and Assigns shall and may for ever hereafter peaceably and quietly have hold use occupy possesse and enjoy the aforesaid parcell of land with the appurtenances without the lett trouble molestacon Eviccon or disturbance of any person or persons whatsoever lawfully clayming or p.rtending to have any estate right title or Interest of in or to the same or any part or parcell thereof from by or under the said John Edmondson and that the said parcell of land is and for ever hereafter shall bee and continue Cleare and free discharged and acquitted By the said John Edmondson his Executo.rs and Admistrato.rs of and from all and all manner of Rents arrearages of Rents and other charges and incumbrances whatsoever ^had made or done or to be^ had made or done by or from the said John Edmondson In witness whereof the said John Edmondson hath hereunto set this hand and seale the day and yeare first above written John Edmondson (sealed) Sealed signed & delivered in the p.rsence of the words seaventy Nine being first interlined between his Second and third lynes in the p.rsence of John Baker John Browne Endorsed on the backside Provinciall Court February the 19.th 1680 The within written Deed was then acknowledged in Open Court by John Edmondson to be the Act and Deed to the uses therein menconed Thomas Tailler |
