121 (112) London This 5.th day of September 1677 Received then of M.r Dare the summe of Three score pounds of good and Lawfull Money of England being y.e Consideracon Money for which I have this day sold to the said William Dare seaverall percells of Land with the appurtenances in the Province of Maryland in parts beyond the seas as by deed of Sale and my hand & seale bearing date w.th these p.rsents made between my self of the one part and the said William Dare of the other part I say Received in full 60.ll witnesse my hand & seale The marke of Rob.t R H Hawkins sealed Sealed and delivered in y.e p.rsence of Jn.o Parker W.m Scorey Pub Notary The Deposiccon of Peter Mills of the County of Saint Maryes Carpent.r and James Greene of the same County plant.r Saith That Twelve years since or thereabouts To the best of theire remembrance at y.e Instant request of Richard Foster late of the County of Saint Maryes deed and John Tennison sen.r of the same County Planter Betweene whome there was then some dispute Touching the Division of a Neck of Land Called Fosters Neck in the Manno.r of S.t Clements in the County aforesaid Which they held of Thomas Gerrard late of the said County Esq.r Dec.d The said Foster holding two thirds thereof and the said Tennison the other third Till w.ch dispute was ended and decided betwixt them the said Gerrard did refuse to signe either of theire Deeds for theire respective parts thereof Went upon the said Land to Lay it out and divide it between them the said Foster and Tennisson being alsoe in Company with them And when they came to a deep Valley of a branch which runneth into Wiccocomico River and and was till then taken for and reputed the bounds of the said Tennissons Land divideing between him and the said Foster the said Tennisson said hee did not thinke that sufficient for his third part but further told the said Foster That to and the dispute If hee would permitt him to runn but five pches Further beyond the said Valley hee would bee Content therew.th in Leiu of his third part without putting themselves to any Farther Trouble To w.ch the said Foster readily Consented and the Deponent Mills Went imeadiately and Cutt a pole and measured out five poles more from the said Valley along the River side to a black Walnutt w.ch hee marked and from thence run w.th a straight Line up into the Woods to a Crooked Oake standing on the side of a Creek Called back Creek w.ch they Likewise marked and concluded the said Line to bee the bounds divideing between the said Foster and Tennisson To w.ch They both Freely Consented and declared themselves therewith Fully satisfied and Contented and soe in friendly mann.r pled And further these Deponenth say not Sworne before me This 11.th day of August 1678 Philip Calvert Canc On the backside of the aforegoing Deposiccon Was thus Written Viz Sept 30.th 1678 S.r I desire that an Order of Court may passe and Mandamus Issue to the Sheriffe of Saint Maryes County to Lay out The Land within mencconed between Foster and Tennisson According to the bounds menconed in the Deposiccan To the Hono.ble Philip Calvert Esq.r Thomas Notley Chancello.r of Maryland These |
