CHAPTER 73
(Senate Bill 89)

AN ACT concerning

Estates and Trusts — Corneal Transplants

FOR the purpose of establishing the powers, duties, and
authority of the Medical Examiner's Office in
providing corneal tissue for transplant, dealing
generally with the liability of the medical
examiner, and generally relating to requirements for
corneal transplants.

Section 4-50 9.1

Annotated Code of Maryland

(1974 Volume and 1974 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 4-509.1 be and it is hereby
added to Article — Estates and Trusts, of the Annotated
Code of Maryland (1974 Volume and 1974 Supplement) to
read as follows:

Article — Estates and Trusts
4-509.1

(A) IN ANY CASE WHERE A PATIENT IS IN NEED OF
CORNEAL TISSUE FOR A TRANSPLANT, THE CHIEF MEDICAL
EXAMINER, THE DEPUTY CHIEF, OR AN ASSISTANT MEDICAL
EXAMINER MAY PROVIDE THE CORNEA UPON THE REQUEST OF THE
MEDICAL EYE BANK OF MARYLAND, INCORPORATED UNDER THE
FOLLOWING CONDITIONS:

(1)    A DECEDENT WHO MAY PROVIDE A SUITABLE
CORNEA FOR THE TRANSPLANT IS UNDER HIS JURISDICTION AND
AN AUTOPSY WILL BE REQUIRED IN ACCORDANCE WITH ARTICLE 22
OF THE CODE:

(2)    NO OBJECTION BY THE NEXT OF KIN IS KNOWN
BY THE MEDICAL EXAMINER; AND

(3)    THE CORNEA FOR TRANSPLANT WILL NOT
INTERFERE WITH THE SUBSEQUENT COURSE OF AN INVESTIGATION
OR AUTOPSY OR ALTER THE POST MORTEM FACIAL APPEARANCE.
