MONTGOMERY COUNTY

Code, 1972, with respect to certain provisions of the
Employees' Retirement System to eliminate entrance age
requirements; to allow any disabled member to accept
another covered position and transfer to Group C; to
include among Group E membership the position of Chief
Administrative Officer; to eliminate mandatory insurance
plan enrollment; to eliminate the cut-off date for
transfer from Group D to Group E; to provide that,
subject to certain conditions, a Group D member who
retired on or after July 1, 1970, and prior to January 1,
197 5, may transfer retroactively to Group E; to eliminate
the maximum advance filing date for retirement
applications; to provide that requests for mandatory
retirement date extension may be initiated by the
employee or the employee's immediate supervisor or
department head and to specify a procedure for review and
approval of such requests; to eliminate maximum age
allowance for membership; to equalize pension benefits of
members retired as the result of administrative or
discontinued service retirement; to clarify the credited
service formula for members who have worked part—time; to
provide for purchase of up to forty—eight months of
credited service for period of military service for all
eligible members; to eliminate age requirements for
members wishing to transfer retirement service credits;
to allow for aggravation of a condition or occupational
disease as reason for service connected disability
retirement; to eliminate the definite time or place
requirement for an occupational disease as reason for
service connected disability retirement; to provide the
Retirement Hearing Board with the authority to require
medical re—examination of disability retirees; to provide
the Retirement Hearing Board with the authority to adjust
pension payments; to clarify the formula for prorating
service of less than a full year; to provide for
consideration of cost—of—living increases when
adjustments to pensions are being made; to eliminate
restrictive beneficiary designation clauses; to provide a
pension option privilege to Group D members who retired
before July 1, 1970; to provide that any member covered
by the retirement plan on April 1, 1970, and continuously
employed thereafter, who has reached elective early
retirement and has at least twenty years of continous
county service, shall be eligible for a pension in an
amount not less than fifty percent of final earnings; to
equalize benefits payable to eligible spouses under
Section 33—46 (a) (2); to provide the County Executive
with the authority to appoint members of the Retirement
Hearing Board subject to confirmation by the County
Council; to allow the members of the Retirement Hearing
Board to designate the chairperson annually; to provide
the Retirement Hearing Board with the authority to
designate a Medical Review Committee; to provide the
Chief Administrative Officer with the authority to
