7-454. LIQUOR, MATCHES, SMOKING, AND TOBACCO.

CARRYING ANY INTOXICATING LIQUOR, OR SMOKING, OR
CARRYING ANY MATCH OF OTHER FLAME-MAKING DEVICE INTO A
MINE IS PROHIBITED. THE OPERATOR MAY SEARCH OR CAUSE
TO BE SEARCHED, ANY PERSON ENTERING OR ABOUT TO ENTER
ANY MINE, TO PREVENT THE PERSON FROM TAKING OR
CARRYING IN THE MINE ANY INTOXICATING LIQUOR, MATCH,
PIPE, CIGAR, CIGARETTE, OR ANY UNAUTHORIZED OR
UNAPPROVED DEVICE FOR MAKING LIGHT OR FIRE.

REVISOR'S NOTE: This section presently appears as
Article 66C, section 620 of the Code. New
language derived from Article 66C, section
618 is added to be consistent with the
authority of the mine operator to search
for these items. The only other changes
made are in style.

7-455. INFLUENCE OR USE OF INTOXICANTS AND DRUGS
PROHIBITED.

A PERSON MAY NOT GO IN OR NEAR A MINE OF ANY
BUILDING OR MACHINERY CONNECTED WITH THE MINE, WHILE
UNDER THE INFLUENCE OF ANY INTOXICANT OR CONTROLLED
DANGEROUS SUBSTANCE AS DEFINED IN ARTICLE 27 OF THE
CODE, EXCEPT WHEN THE CONTROLLED DANGEROUS SUBSTANCE
IS BEING USED UNDER MEDICAL SUPERVISION. A PERSON MAY
NOT USE, CARRY, OR HAVE IN HIS POSSESSION AT, IN, OR
NEAR ANY MINE OR ANY BUILDING OR MACHINERY CONNECTED
WITH THE MINE, ANY INTOXICANT OR CONTROLLED DANGEROUS
SUBSTANCE EXCEPT WHEN THE CONTROLLED DANGEROUS
SUBSTANCE IS BEING USED UNDER MEDICAL SUPERVISION.

REVISOR'S NOTE: This section presently appears as
Article 66C, section 652 of the Code. The
last clause is proposed for deletion in
light of the uniform penalty provisions in
subtitle 8. New language is added to
define the type of drug to be prohibited
and excepts any person acting under medical
supervision. The only other changes made
are in style.
