distinct from the uniform penalty
provisions of this title. However, new
language is added to make applicable other
uniform provisions. The provisions dealing
with the collection and remittance of any
fine is based upon the last sentence of the
first paragraph of section 246. However,
this provision is revised in light of the
District Court system which provides for
collection of fines by that court pursuant
to Article 26, section 155. The only other
changes made are in style.

4-503. DYNAMITING STREAMS PROHIBITED EXCEPT FOR
CERTAIN PURPOSES.

A PERSON MAY NOT PLACE, THROW, OR MAKE USE OF ANY
DYNAMITE OR OTHER EXPLOSIVE SUBSTANCE IN ANY WATER IN
THE STATE, EXCEPT FOR ENGINEERING, MILLING, OR MINING
PURPOSES. ANY PERSON WHO VIOLATES THIS SECTION IS
GUILTY OF A MISDEMEANOR AND UPON CONVICTION IS SUBJECT
TO A FINE OF NOT LESS THAN $100 NOR EXCEEDING $300, OR
IMPRISONMENT FOR NOT LESS THAN ONE YEAR NOR EXCEEDING
THREE YEARS, OR BOTH, WITH COSTS IMPOSED IN THE
DISCRETION OF THE COURT.

REVISOR'S NOTE: This section is new language
derived from Article 66C, sections 204 and
247 of the Code. They are identical in
language and are proposed for repeal in
light of section 4-503.

The particular penalty provision of this
section is retained because it differs from
the uniform penalty provision of the title
by allowing a greater period of
incarceration.

4-504. THRESHING STREAMS PROHIBITED; EXCEPTION IN
KENT AND QUEEN ANNE'S COUNTIES.

A PERSON MAY NOT WHIP OR BEAT ANY WATERS OF THE
STATE WITH A POLE, STICK, OR ANY OTHER THING IN ORDER
TO DRIVE FISH INTO ANY DEVICE FOR CATCHING FISH. IN
KENT COUNTY AND QUEEN ANNE'S COUNTY, THIS SECTION
APPLIES ONLY TO WATERS OF THE SASSAFRAS RIVER AND ITS
TRIBUTARIES.
