4-410. PURPOSE OF SECTION; TRESPASSING ON FISH
REFUGES OR LANDS CONTROLLED BY DEPARTMENT PROHIBITED.

(A) PURPOSE OF SECTION. - THIS SECTION IS
INTENDED TO PROTECT THE STATE IN ITS OBJECTIVE TO
PROPAGATE AND MANAGE FISH ON FISH REFUGES, LANDS, AND
WATERS CONTROLLED BY THE DEPARTMENT.

(E) TRESPASSING ON FISH REFUGES OR LANDS
CONTROLLED BY THE DEPARTMENT PROHIBITED. - AN
UNAUTHORIZED PERSON MAY NOT ENTER OR TRESPASS ON OR
DESTROY, DEFACE, OR DAMAGE ANY FISH REFUGE OR LANDS
ACQUIRED FOR FISH PONDS OR HATCHERIES WITHOUT THE
CONSENT OF THE DEPARTMENT. A PERSON MAY NOT ALLOW ANY
DOG, DOMESTIC STOCK, OR POULTRY TO ENTER ON ANY STATE
FISH REFUGE.

REVISOR'S NOTE: Subsection (a) is new language
derived from the first sentence of Article
27, section 579 of the Code.

Subsection (b) presently appears as Article
27, section 579, as amended by Chapter 181,
Acts of 1972, of the Code and set forth
here because its subject matter is germane
to this title. New language derived from
the first two sentences of Article 66c,
section 194 is added. The phrase "land or
waters owned or controlled by the State for
the use of the ... Fish Department
." is proposed for deletion because these
lands are fish refuges. The only other
changes made are in style.

SUBTITLE 5. OBSTRUCTING THE PASSAGE OF FISH;
INTERFERENCE WITH NETS AND FISHING, AND OTHER
PROHIBITIONS GENERALLY.

4-501. OBSTRUCTING THE PASSAGE OF FISH PROHIBITED.

AN OBSTRUCTION MAY NOT BE PLACED AT THE MOUTH OF
ANY CREEK, COVE, OR INLET, OR ACROSS ANY STREAM, SO AS
TO IMPOUND ANY FISH AND PREVENT ITS FREE PASSAGE TO
AND FROM THE WATER OR ITS FREE ACCESS DP AND DOWN THE
STREAM. HOWEVER, A DAM MAY BE ERECTED IF FISH LADDERS
ARE MAINTAINED IN ACCORDANCE WITH THE PROVISIONS OF
THIS SUBTITLE.
