Subsection (b) is new language derived from
Art. 87, §40.
Subsection (c) is new language derived from
Art. 87, §§ 41-44, with respect to criminal
matters, and §§ 28-31, and 38 with respect
to civil matters.
Subsection (d) is new language derived from
Art. 87, §§ 31, 38, and 43 dealing with
criminal and civil matters respectively,
and which are proposed for repeal.
The provisions relating to collection of
fees, or performance of other duties after
a sheriff leaves office are now covered in
§2-103 of this article which requires a
sheriff's successor to perform these
duties.
The provisions of §§ 28-32 relating to
amercement for failure to pay over fees and
the procedure for collection are proposed
for repeal.
Art. 87, §§ 40-44 are proposed for repeal.
SEC. 2-309. SALARIES AND EXPENSES; DEPUTIES;
EMPLOYEES; EQUIPMENT.
(A) IN GENERAL.
THE SHERIFF OF A COUNTY AND HIS DEPUTIES SHALL
RECEIVE THE ANNUAL SALARIES PROVIDED BY THIS SECTION
FOR PERFORMING THE DUTIES REQUIRED OF THEM BY THE
CONSTITUTION AND THE LAWS OF THIS STATE. THEY SHALL
BE REIMBURSED FOR EXPENSES AS PROVIDED BY LAW.
(B) ALLEGANY COUNTY.
(1) THE SHERIFF OF ALLEGANY COUNTY SHALL
RECEIVE A SALARY OF AT LEAST $7,800, THE EXACT AMOUNT
TO BE SET BY THE COUNTY COMMISSIONERS FROM TIME TO
TIME, AND AN EXPENSE ALLOWANCE OF $1,200 ANNUALLY, THE
DISBURSEMENT OF WHICH SHALL BE ACCOUNTED FOR TO THE
COUNTY COMMISSIONERS.
(2) THE SHERIFF SHALL APPOINT[[,]] NOT
LESS THAN FIVE DEPUTIES AT SALARIES OF AT LEAST $3,300
EACH WHO ARE UNDER THE COUNTY CLASSIFIED SERVICE; ONE
OF THESE DEPUTIES SHALL BE ASSIGNED BY THE SHERIFF TO
