SEC. 7-407. SALES AGENCY TO KEEP RECORDS OF TOBACCO
GROWN OUTSIDE STATE.
EVERY COMMISSION SALES AGENCY SHALL KEEP A RECORD
OF EVERY SALE OF LEAF TOBACCO GROWN OUTSIDE THE STATE.
REVISOR'S NOTE: This section is new language
derived from the last sentence of Art. 48,
§67 of the Code. The only changes made are
in style.
SEC. 7-408. WAREHOUSE OWNERS TO HAVE PROPER WEIGHTS
AND MEASURES; INSPECTION BY STATE SUPERINTENDENT.
(A) OWNER TO HAVE PROPER WEIGHTS AND MEASURING
DEVICES.
EVERY LEAF TOBACCO MARKET SHALL HAVE PROPER
WEIGHTS, MEASURES, WEIGHING DEVICES, AND MEASURING
DEVICES THAT CONFORM TO THE LAWFUL STANDARD AND ARE
KEPT IN PROPER REPAIR.
(B) INSPECTION BY STATE SUPERINTENDENT OF WEIGHTS
AND MEASURES.
THE [[STATE SUPERINTENDENT OF WEIGHTS AND
MEASURES]] SECRETARY SHALL INSPECT PERIODICALLY ALL
WEIGHTS, MEASURES, WEIGHING DEVICES, AND MEASURING
DEVICES. HE SHALL CERTIFY THAT FACT.
REVISOR'S NOTE: This section presently appears as
Art. 48, §52 of the Code. The present
reference in subsection (a) to "the
proprietor or manager of every warehouse
holding tobacco for sale" is proposed for
deletion and "leaf tobacco market" is
substituted. This addition is made so that
this section is applicable to the State
Warehouse and the loose leaf auction markets.
If a private warehouse violates this
provision the State will have recourse
against the owner or the manager, if he is an
agent.
In subsection (b), the present reference to
the Commissioner of Labor and Industry is
proposed for deletion because none of his
duties relate to the accuracy of weights and
measures; See Art. 89. The present reference
to the State Superintendent of Weights and
Measures also is proposed for deletion in
