constitute the Fire Board.
SECTION 11. Section 37-2, title "Fire board,"
Chapter 37, title "Kensington," of the Montgomery
County Code 1965, as amended, is hereby repealed and
re-enacted, with amendments, to read as follows;
Sec- 37-1. Fire Board.
(a) There is hereby created a body to he
known as the Kensington Fire Board, which shall manage
the financial affairs of the Kensington Volunteer Fire
Department, Inc., and exercise such other authority as
is vested in it by this chapter. The Firs Board shall
consist of fifteen members, two of whom shall bo
members of the Kensington Volunteer Fire Department,
Inc., and who shall be designated, elected or
appointed from time to time by the fire department in
such manner and for such terms as it shall determine;
provided, that such members shall be residents of the
Kensington Fire Area, outlined on the map following
Section 27-3 of this Code. The remaining thirteen
members of the Fire Board shall be residents and real
estate taxpayers within the Kensington Fire Area and
shall be elected by the Kensington Fire Area
Committee, created in the manner provided in this
chapter; provided, however, that three members of the
Fire Board shall reside within that portion of the
Kensington Fire Area lying south and southwest of the
Metropolitan Branch of the Baltimore and Ohio
Railroad, hereinafter known as Area No. 1; six members
of the Fire Board shall reside within that portion of
the fire area lying north and northeast of such
railroad west of Georgia Avenue, south of Layhill Road
and Big Branch Creek, and east of Rock Creek,
hereinafter known as Area No. 2; and four members of
the Fire Board shall reside within the remaining
portion of the fire area, hereinafter known as Area
No. 3. No person shall be eligible to serve
concurrently as a member of the Kensington Fire Board
and the Kensington Fire Area Committee. Any member of
the Fire Board elected by the Fire Area Committee who
shall cease to be either a resident or real estate
taxpayer within the fire area shall thereupon be
dropped from the membership of the Fire Board, and the
Fire Area Committee shall promptly elect a new member
to fill any such vacancy so occurring. No member of
the Kensington Volunteer Fire Department, Inc., shall
be eligible to serve as the representative on the Fire
