(B)   IF THE LANDLORD FAILS TO PROVIDE THE TENANT WITH
POSSESSION OF THE DWELLING UNIT AT THE BEGINNING OF THE
TERM OF ANY LEASE, THE RENT PAYABLE UNDER THE LEASE
SHALL ABATE UNTIL SUCH TIME AS POSSESSION IS DELIVERED;
AND THE TENANT MAY, UPON WRITTEN NOTICE TO THE
LANDLORD, TERMINATE, CANCEL AND RESCIND THE RENTAL
AGREEMENT, AND UPON THE TERMINATION, CANCELLATION AND
RESCISSION, THE LANDLORD SHALL RETURN ALL MONEY OR
PROPERTY GIVEN AS PREPAID RENT, DEPOSIT, OR SECURITY, AND,
IN ADDITION, PAY SUCH CONSEQUENTIAL DAMAGES AS A COURT
MAY DEEM APPROPRIATE.

(C)     THIS SECTION SHALL ONLY APPLY TO SINGLE OR
MULTI-FAMILY DWELLING UNITS.

SEC. 6. AND BE IT FURTHER ENACTED, That this Act is hereby declared
to be an emergency measure and necessary for the immediate preservation of the
public health and safety and having been passed by a yea and nay vote supported
by three-fifths of all the members elected to each of the two Houses of the General
Assembly, the same shall take effect from the date of its passage.

CHAPTER 3
(Executive Order 1)

AN EXECUTIVE ORDER PURSUANT TO ARTICLE II, SECTION 24, OF
THE CONSTITUTION OF MARYLAND, to repeal and re-enact, with
amendments, Section 205A of Article 41 of the Annotated Code of Maryland
(1971 Replacement Volume), title "Governor - Executive and Administrative
Departments," subtitle "8. The Department of Employment and Social
Services"; and to repeal and re-enact, with amendments, Sections 2(a), 2(c) and
4(b) of Article 70B of the Annotated Code of Maryland (1970 Replacement
Volume and 1972 Supplement), title "Commission on the Aging"; to transfer
the Commission on Aging from the Department of Employment and Social
Services to the Executive Department of State Government; to remove all
references to the State Coordinating Commission on Problems of the Aging and
the Commission on Aging as being part of the Department of Employment and
Social Services; to modify the procedure for appointing the Commission on the
Aging; to repeal a requirement that annual reports of the Commission be sent
to the Secretary of Employment and Social Services, and relating generally
thereto.

SECTION 1. BE IT ORDERED BY THE GOVERNOR OF MARYLAND
PURSUANT TO ARTICLE II, SECTION 24, OF THE CONSTITUTION OF
MARYLAND, That Section 205A of Article 41 of the Annotated Code of
Maryland (1971 Replacement Volume), title "Governor - Executive and
Administrative Departments," subtitle "8. The Department of Employment and
Social Services," be and it is hereby repealed and re-enacted, with amendments, to
