CHAPTER 192
(House Bill 1598)

AN ACT to repeal Section 31 of Article 2B of the Annotated Code of Maryland
(1968 Replacement Volume), title "Alcoholic Beverages," subtitle "Local
Licenses and License Provisions," and to add new Section 57(d-l) to the same
Article, Code and title, subtitle "Application for License," to follow
immediately after Section 57(d) thereof, to provide that in Calvert County the
restriction against obtaining certain alcoholic beverage licenses by one who sells
motor vehicle fuel is removed and to permit the Calvert County Board of
License Commissioners to waive certain residence requirements for obtaining
certain alcoholic beverage licenses.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 31 of Article 2B of the Annotated Code of Maryland
(1968 Replacement Volume), title "Alcoholic Beverages," subtitle "Local Licenses
and License Provisions," be and it is hereby repealed; that new Section 57(d-l) be
and it is hereby added to the same Article, Code and title, subtitle "Application
for License," to follow immediately after Section 57(d) thereof, and all to read as
follows:

31.

[In Calvert County a licensee who did not hold any type of Class B license (on
sale-hotels and restaurants) on March 25, 1957, and who subsequently obtains any
type of such a license shall not sell or otherwise dispose of motor vehicle fuel on
the same premises, if such motor vehicle fuel is intended for use in motor vehicles,
as that term is defined in Article 66-1/2 of this Code.]

57.

(D-l) IN CALVERT COUNTY THE BOARD OF LICENSE
COMMISSIONERS SHALL HAVE POWER TO WAIVE THE TWO YEARS
RESIDENCE REQUIREMENT CONTAINED IN SECTION 56
HEREINABOVE IN ANY CASE IN WHICH A PERSON APPLYING FOR
THE TRANSFER OF A LICENSE OF A GOING BUSINESS IS THE BONA
FIDE PURCHASER AND PROPRIETOR THEREOF IF THE PERSON CAN
SUBMIT TO THE SATISFACTION OF THE BOARD PROPER PERSONS
WHO KNOW HIM AND CAN VOUCH FOR HIS GOOD CHARACTER OR
IF HE CAN SUBMIT TO THE SATISFACTION OF THE BOARD OTHER
EVIDENCE THAT HE IS A FIT AND PROPER PERSON TO HOLD THE
LICENSE.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1973.
