2172                                    MUNICIPAL CHARTERS

RESOLUTION of the Mayor and City Council of Cumberland, Maryland,
adopted in pursuance of the authority contained in Article 11-E of the Constitution
of the State of Maryland, and Section 13 of Article 23A of the Annotated Code of
Maryland, entitled "Municipal Corporations," as said Section was enacted by
Chapter 423 of the Acts of the General Assembly of Maryland, 1955, entitled "A
RESOLUTION TO AMEND THE CHARTER OF THE CITY OF
CUMBERLAND, MARYLAND (1966 EDITION), BY REPEALING AND
RE-ENACTING, WITH AMENDMENTS, SECTIONS 33 AND 34, FOUND
UNDER THE SUBTITLES 'BOARD OF HEALTH" AND 'ENGINEER'
RESPECTIVELY."

SECTION 1: BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL
OF CUMBERLAND, MARYLAND, That Section 33 of the Charter of the City
of Cumberland (1966 Edition) be and is hereby repealed and re-enacted to read as
follows:

There is hereby created a Board of Health. The Board of Health shall consist of
seven (7) persons, including the Mayor, [City Engineer,] DIRECTOR OF
PUBLIC WORKS, OR HIS DESIGNATED REPRESENTATIVE, Fire Chief,
Health Officer of Allegany County, and three (3) residents of the City of
Cumberland, one a bona fide owner of residential property and one a reputable
practicing physician, who shall be appointed by the Mayor, subject to confirmation
by the City Council, all of whom shall serve in such office without remuneration or
pay.

"The Board of Health shall have the authority to generally do all acts and make
all regulations, subject to ratification by the Mayor and City Council, which may
be necessary for the promotion of health and sanitation, or for the suppression of
disease, and the Board of Health shall perform such other duties as the Mayor and
City Council may, from time to time, prescribe.

"The Health Officer of Allegany County shall be the Secretary of the Board of
Health. He, or his authorized representative, shall be empowered to enter all
dwellings and other places, whether public or private, at all reasonable times, in
the discharge of his duty to uphold and enforce the health laws of the State of
Maryland, City of Cumberland, and such regulations of the Maryland State
Department of Health as may, from time to time, be promulgated. The Health
Officer shall have the authority to designate the representative who shall have the
authority to carry out, at his direction, any duty imposed upon the Health Officer
by the provisions of the Charter of the City of Cumberland, or any ordinances of
the City of Cumberland."

SECTION 2: AND BE IT FURTHER RESOLVED, That Section 34 of the
Charter of the City of Cumberland (1966 Edition), which reads as follows:

[The Engineer of said City shall be a professional Civil Engineer, and it shall be
his duty to ascertain the established monuments of said City, and from them to
extend surveys thereof, and establish others, and to locate, establish and survey all
streets and alleys within the territorial limits of said City when so called on or
required to do so. He shall maintain the grade of all streets and alleys in said City
and exercise general supervision and superintendence over all work undertaken on
the streets, alleys and public squares thereof, make estimates and plans and give
instructions as to grading or otherwise improving the same, and with respect to the
construction of sidewalks, so as to secure and preserve proper proportions and
uniformity in the height and width thereof; and also to superintend the
construction of all culverts, bridges, drains, water works and other improvements
projected by the said Mayor and City Council; and he shall see that all parties
contracting with the said Mayor and City Council to do any work as aforesaid
