CHAPTER 727
(Senate Bill 965)

AN ACT to add new Section 9J to Article 64A of the Annotated Code of
Maryland (1972 Replacement Volume and 1972 Supplement), title "Merit
System," to follow immediately after Section 9-I thereof; and to repeal Section
192 of the Code of Public Local Laws of Harford County (1965 Edition, being
Article 13 of the Code of Public Local Laws of Maryland), title "Harford
County Code," subtitle "Circuit Court," subheading "Parole and Probation," to
require the transfer of local parole and probation employees in Harford County
to the State of Maryland on July 1, 1974, to provide for the rights and benefits
of transferred employees, to provide for the assumption of certain duties and
functions by the State Division of Parole and Probation and to repeal the local
law providing for parole and probation in Harford County.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 9J be and it is hereby added to Article 64A of
the Annotated Code of Maryland (1972 Replacement Volume and 1972
Supplement), title "Merit System," to follow immediately after Section 9-I
thereof, to read as follows:

9J.

(A)  AS OF JULY 1, 1974, ANY EMPLOYEES OF HARFORD COUNTY
WHO WERE PERFORMING PAROLE AND PROBATION DUTIES
UNDER THE DIRECTION OF THE DIRECTOR OF PROBATION SHALL
BE TRANSFERRED TO THE STATE DIVISION OF PAROLE AND
PROBATION, AND THE DIVISION ON AND AFTER JULY 1, 1974,
SHALL ASSUME ALL OF THE DUTIES AND FUNCTIONS PREVIOUSLY
ASSIGNED TO THE EMPLOYEES OF HARFORD COUNTY
DESIGNATED UNDER THIS SUBSECTION, INCLUDING THE
DISPOSITION OF MATTERS PENDING ON THAT DATE.

(B)  THOSE EMPLOYEES WHO ARE TRANSFERRED SHALL BECOME
CLASSIFIED EMPLOYEES OF THE STATE, SUBJECT TO THE
PROVISIONS OF THE STATE MERIT SYSTEM LAW UNDER THIS
ARTICLE AND SHALL BE PLACED IN THAT POSITION WHICH IS
COMPARABLE OR MOST CLOSELY COMPARES WITH THEIR
FORMER POSITION, WITHOUT FURTHER EXAMINATION OR
QUALIFICATION, AND WITHOUT DIMINUTION OR LOSS OF ANY
BENEFITS TO WHICH ENTITLED PRIOR TO JULY 1, 1974. THEY
SHALL BE CREDITED WITH THE YEARS OF SERVICE RENDERED IN
HARFORD COUNTY FOR PURPOSES OF DETERMINING
COMPENSATION RATES, INCLUDING LONGEVITY STEPS, AND THE
BASIC RATES FOR ANNUAL LEAVE AND SICK LEAVE.

(C)  THOSE EMPLOYEES WHO ARE TRANSFERRED SHALL BECOME
MEMBERS OF THE STATE EMPLOYEES PENSION SYSTEM UNDER
ARTICLE 73B OF THIS CODE, AND SHALL TRANSFER ALL
CONTRIBUTIONS AS PROVIDED IN SECTION 32A OF ARTICLE 73B.

SECTION 2. AND BE IT FURTHER ENACTED, That Section 192 of the
Code of Public Local Law of Harford County (1965 Edition, being Article 13 of
the Code of Public Local Laws of Maryland), title "Harford County Code,"
subtitle "Circuit Court," subheading "Parole and Probation," be and it is hereby
repealed.
