1492                                      LAWS OF MARYLAND                                 Ch. 709

695A. NOISE POLLUTION CONTROL ADVISORY COUNCIL

(A)   THE SECRETARY SHALL APPOINT AND MAINTAIN A NOISE
POLLUTION CONTROL ADVISORY COUNCIL COMPRISED OF FIVE
MEMBERS, WHO ARE RESIDENTS OF MARYLAND. ONE MEMBER
SHALL BE APPOINTED FROM A LIST OF AT LEAST THREE NAMES
SUBMITTED BY THE ACOUSTICAL SOCIETY OF AMERICA. ONE
MEMBER SHALL BE A DOCTOR OF MEDICINE, SPECIALIZING IN
HEARING, APPOINTED FROM A LIST OF AT LEAST THREE NAMES
SUBMITTED BY THE MEDICAL AND CHIRURGICAL FACULTY OF
MARYLAND. ONE MEMBER SHALL BE APPOINTED FROM A LIST OF
AT LEAST THREE NAMES SUBMITTED BY THE PRESIDENT OF THE
UNIVERSITY OF MARYLAND. THE REMAINING TWO MEMBERS
SHALL BE APPOINTED AT THE DISCRETION OF THE SECRETARY
WHO SHALL SOLICIT AND CONSIDER SUGGESTIONS FOR THIS
PURPOSE FROM THE MARYLAND STATE CHAMBER OF COMMERCE,
THE MARYLAND TRANSPORTATION FEDERATION, THE
MARYLAND ENVIRONMENTAL TRUST AND SUCH OTHER
ENVIRONMENTAL GROUPS AS HE MAY SELECT. THE SECRETARY,
IN MAKING HIS APPOINTMENTS, SHALL GIVE DUE
CONSIDERATION TO REPRESENTATION FROM THE VARIOUS
GEOGRAPHIC AREAS OF THE STATE.

(B)   EACH MEMBER SHALL BE APPOINTED FOR A TERM OF FIVE
(5) YEARS AND SHALL SERVE UNTIL A SUCCESSOR IS APPOINTED
AND QUALIFIED; PROVIDED, HOWEVER, THAT OF THE FIRST
APPOINTEES, ONE SHALL HOLD OFFICE FOR A PERIOD OF ONE
YEAR, ONE SHALL HOLD OFFICE FOR A PERIOD OF TWO YEARS,
ONE SHALL HOLD OFFICE FOR A PERIOD OF THREE YEARS, ONE
SHALL HOLD OFFICE FOR A PERIOD OF FOUR YEARS, AND ONE
SHALL HOLD OFFICE FOR A PERIOD OF FIVE YEARS.

(C)   UPON THE DEATH, RESIGNATION, OR THE EXPIRATION OF
THE TERM OF ANY MEMBER, THE VACANCY SO CREATED SHALL
BE FILLED IN THE MANNER PROVIDED FOR THE VACATED
POSITION FOR A FULL OR PARTIAL TERM AS THE CASE MAY BE. A
MEMBER SHALL BE ELIGIBLE TO SUCCEED HIMSELF, PROVIDED
HIS NAME IS ON THE APPROPRIATE LIST WHERE A LIST IS
REQUIRED.

(D)  THE MEMBERS OF THE NOISE COUNCIL SHALL RECEIVE NO
COMPENSATION FOR THEIR SERVICES AS MEMBERS, BUT SHALL
BE REPAID FOR ACTUAL EXPENSES INCURRED IN THE
PERFORMANCE OF THEIR DUTIES UNDER THIS SUBTITLE.
SECRETARIAL AND STENOGRAPHIC ASSISTANCE SHALL BE
PROVIDED BY THE DEPARTMENT.

(E)  THE SECRETARY OF HEALTH AND MENTAL HYGIENE SHALL
DESIGNATE THE CHAIRMAN, THE VICE-CHAIRMAN, AND THE
SECRETARY OF THE NOISE COUNCIL.

(F)  THE NOISE COUNCIL SHALL MEET AT SUCH PLACES AS MAY
BE SPECIFIED BY CALL OF THE CHAIRMAN OR THE SECRETARY OF
HEALTH AND MENTAL HYGIENE.

(G)      PRIOR TO THE DEPARTMENT'S SUBMITTING ANY
RECOMMENDED REGULATIONS FOR THE ESTABLISHMENT OF
STANDARDS FOR NOISE CONTROL, THE DEPARTMENT SHALL
