may be transferred to said Maryland Historical Trust.

14B.

(a)    The Board of Public Works, acting pursuant to a formal request by the
Maryland Historical Trust, may acquire part or all of any property and premises
which in the judgment of the Maryland Historical Trust is an historic landmark
worthy of public care and preservation, by purchase or gift under the procedures in
[Article 33A] TITLE 12 OF ARTICLE 21 of this Code with any funds available
for this purpose from time to time.

(b)   Pursuant to the provisions of § 181-I of Article 41 of this Code (1965
Supplement, as amended), the Board of Public Works may select the Maryland
Historical Trust as the agency designated to control and administer the property
and premises thus acquired, and for these purposes title to or other interest in the
property and premises may be transferred to the Maryland Historical Trust, or the
Board of Public Works may transfer title to or other interest in the property and
premises to an appropriate governmental agency or a private agency or
corporation, subject to covenants and conditions for proper maintenance and
control of the property and premises and for its reversion and return to the Board
of Public Works if these covenants and conditions are not performed.

(b) The acquisition may be by purchase, gift, exchange, or condemnation under
the procedures in [Article 33A] TITLE 12 OF ARTICLE 21 of this Code, with
any funds available for the purpose from time to time.

Article 89B.

(b) The Administration may acquire for the State of Maryland by agreement,
gift, grant, purchase or condemnation proceedings as prescribed by the provisions
of [Article 33A of the Annotated] TITLE 12 OF ARTICLE 21 OF THIS Code
[of Maryland], any private property, rights or easements, for public purpose, that
may be, in its judgment desirable or necessary to perform the duties imposed by
this article, provided that the authority and function vested in the State Roads
Commission by Article III, § 40B of the Maryland Constitution shall be
performed by said Commission.

8A.

(a) In order to prevent further loss of gasoline tax revenue caused by the failure
of a substantial number of motorists to use U.S. Route 40 between Hancock and
the Pennsylvania line and in order to promote and enhance the economic welfare
of the westernmost counties of Maryland the State Roads Commission is
authorized to acquire by purchase, gift or condemnation real property or any
interest in such property adjacent to or near U.S. Route 40 between Hancock in
Washington County and the Pennsylvania line in Garrett County for the purpose
of providing areas suitable for roadside parks and recreational areas, provided that
such authorization shall be limited to ten roadside parks and recreational areas
each not to exceed an area of twenty acres, and provided further that no such area
shall be acquired by the State Roads Commission until written approval is received
from the Department of [Forests and Parks] NATURAL RESOURCES to the
effect that [such] THE land is appropriate for and will be developed by said
Department as a park or recreational area.
