widow of a judge who dies during active service shall have been
married to him for a period of not less than three years prior to his
death, and, in the case of a death of a retired judge, not less than
three years before his retirement. A widow who is entitled to a pension
under the provisions of this subsection shall be paid for the period of
her life unless she remarries, in which event the pension is to cease
and terminate. The provisions of this subsection shall apply to the
widows who have not remarried and who are otherwise qualified as
provided herein, or judges who died before January 1, 1962.

(3) A judge who became a judge of the District Court pursuant to
Article IV, Section 41-I (g) of the Constitution, or the widow of such
a judge, may elect to receive the benefits provided by this subsection,
or the benefits provided by Section 144 of this Article.

(d) Trial magistrates in Calvert County.

Every full-time trial magistrate for Calvert County holding office
prior to January 1, 1971, shall be paid after the termination of his
active service as such full-time trial magistrate, a pension or salary
to be calculated at the rate of five hundred dollars ($500) per annum
for each year, or part of a year thereof, of active service as such
full-time trial magistrate for Calvert County up to and including
twelve years of such service, including service after January 1, 1971,
so that the maximum pension or salary for such service payable here-
under to any one person shall not exceed the sum of six thousand
dollars ($6,000) per annum. This subsection shall not apply to sub-
stitute trial magistrates. A former trial magistrate who accepts a
salaried public office or position, municipal, county, State or federal,
shall not be paid any pension or salary so long as he remains in such
office or position. In the event that a retired trial magistrate holding a
salaried public office or position should thereafter relinquish such
office or position, and notify the County Commissioners of Calvert
County of such fact, then from and after the date of such notification
the trial magistrate shall be entitled to all the benefits as provided by
this subsection. The County Commissioners of Calvert County are
hereby expressly authorized to levy for and pay pensions and salaries
to such trial magistrates as herein provided.

Section 27. And be it further enacted, That Section 17 of Article
26A, Annotated Code of Maryland (1966 Replacement Volume, 1971
Supplement), title "Criminal Injuries Compensation Act," be and it
is hereby repealed and re-enacted, with amendments, to read as fol-
lows:

17. Additional cost to be imposed in criminal cases.

Where any person is convicted after July 1, 1968, of any crime by
any judge[, or trial magistrate,] with criminal jurisdiction, there
shall be imposed as additional cost, in the case, in addition to any
other costs required to be imposed by law, the sum of five dollars ($5).
All such sums shall be paid over to the Comptroller of the State to be
deposited in the general funds of the State. Under no condition shall
a political subdivision be held liable for the payment of this sum of
five dollars ($5). Crime as used in this section does not include viola-
tions of Articles 66½ (Motor Vehicles) or 66C (Natural Resources)
of this Code.
