and 1967 Supplement being Article 1 of the Code of Public Local
Laws of Maryland), title "Allegany County," subtitle "LaVale Sani-
tary Commission," to provide that the compensation of the vari-
ous employees of the Sanitary Commission not be subject to the
determination of the Board of County Commissioners of Allegany
County.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 314 of the Code of Public Local Laws of Allegany
County (1963 Edition, being Article 1 of the Code of Public Local
Laws of Maryland), title "Allegany County," subtitle "LaVale San-
itary Commission," be and it is hereby repealed and re-enacted, with
amendments, to read as follows:
314.
For the purpose of carrying out the provisions of this subtitle,
the sanitary district created hereafter shall be under the jurisdic-
tion of a Commission of three persons, all of whom shall be appointed
by the Board of County Commissioners of Allegany County, and
all of whom shall reside in Allegany County, within the limits of
Election District 29, be resident taxpayers of said county and qual-
ified voters thereof. The term of each of the three members shall
be six years or until their successors are appointed and have quali-
fied, except that the first Commissioner named by said Board of
County Commissioners shall serve for two years, the second for
four years, and the third for six years from the date of their ap-
pointment; and as to the term of each Commissioner expires, his
successor shall be appointed by the Board of County Commis-
sioners of Allegany County. Any vacancy in the personnel of the
Commission shall be filled by appointment by the Board of County
Commissioners of Allegany County for the unexpired term. The
Commission shall elect one of its members as Chairman, and shall
appoint, discharge at pleasure, and [, subject to the approval of the
Board of County Commissioners of Allegany County,] shall fix the
compensation of the secretary-treasurer, a chief engineer, and such
engineering, legal, clerical and other personnel and help, as from
time to time the Commission may deem necessary to carry out the
provisions of this subtitle. The annual salary of each of said Com-
missioners shall be determined by the Board of County Commis-
sioners of Allegany County, but said annual salary for the chair-
man shall not exceed $100.00, and that of the other members shall
not exceed $50.00.
Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1972.
