70-8 (59-4). Removal of members; vacancies.
The appointing body of Prince George's County and the County
[Executive of Montgomery County with the approval of the County.]
Council of Montgomery County may remove any member from that
county prior to the expiration of the term for which he was appointed.
In such case, the cause of removal shall be stated in writing and a
public hearing held thereon. Any vacancy occurring in the member-
ship of the Commission from Montgomery County for any cause shall
be filled by the County [Executive of the County, subject to the con-
firmation of the County] Council, for the unexpired term and any
vacancy occurring in the membership of the Commission from Prince
George's County shall be filled in the manner provided herein for the
making of appointments to the Commission. A person appointed to
fill any such vacancy for an unexpired term shall be a member of the
same political party as was represented by the member who vacated
the office.
70-9 (59-5). Compensation of members; full-time members.
Each member of the Commission shall receive an annual salary of
forty-eight hundred dollars ($4,800), payable monthly from the
administrative tax collected by the Commission. In the discretion of
the governing body of Prince George's County [and the County
Executive of Montgomery County, with the approval of the County
Council], a member of the Commission from [each] that county
may be designated to serve on a full-time basis, and this member
may be either the chairman or the vice-chairman of the Commission,
if the governing body of Prince George's County [or the County
Executive of Montgomery County] so directs.
The Montgomery County Council may designate a member of the
Commission from that County to serve on a full-time basis provided
that person has been designated by that County under the provisions
of Section 70-10 of this chapter to serve as chairman or vice-chair-
man of the Commission. For any [such] member designated by
Marvin Mandel, Governor 1819
whose name appears on such list, or in the event that no name appears
on such list, the County [Executive] Council shall provide for the
preparation of a second list and shall follow the procedure applicable
to the first such list. All such appointments or reappointments shall
be subject to Section 70-18 of this Code.
The term of office of each member of the Commission shall be for
four years. Appointments shall be made on or before June 15 of the
year in which any appointment is to be made and terms of office
shall begin as of that date and if any appointment is not made as
provided in Section 70-6 of this Code, a vacancy exists which shall
be filled as provided in this subtitle for the filling of vacancies on the
Commission. The members of the Commission in office immediately
prior to June 1, 1959, shall remains in office under the provisions of
this chapter for the remainder of the terms to which respectively ap-
pointed. Those terms shall expire on the following dates: two from
each county on June 14, 1959; one from each county on June 14, 1960;
one from each county on June 14, 1961; and one from each county
on June 14, 1962. Members from Montgomery County may continue
to serve until their successors are appointed and have qualified.
