Section 166 thereof, and to be under the new subtitle, "Consumer
Products Guaranty Act," and new subheadings, "Definitions and
Rules of Construction," "Duties of Guarantors," "Defenses Avail-
able to Guarantors," "Disclosure Requirements," "Full or Partial
Guaranties," "Service Contracts," "Designation of Representa-
tives," "Consumer Protection Division," and "Remedies," to provide
standards for guaranties covering consumer products and gener-
ally relating thereto.
Section 1. Be it enacted by the General Assembly of Maryland,
That new Sections 167 through 176 be and they are hereby added
to Article 83 of the Annotated Code of Maryland (1969 Replacement
Volume and 1971 Supplement), title "Sales and Notices," to follow
immediately after Section 166 thereof, and to be under the new sub-
title "Consumer Products Guaranty Act," and new subheadings "Defi-
nitions and Rules of Construction," "Duties of Guarantors," "De-
fenses Available to Guarantors," "Disclosure Requirements," "Full
or Partial Guaranties," "Service Contracts," "Designation of Repre-
sentatives," "Consumer Protection Division," and "Remedies," and all
to read as follows:
CONSUMER PRODUCTS GUARANTY ACT
167.
This Act may be cited as the "Consumer Products Guaranty Act."
168.
Definitions and Rules of Construction
For the purposes of this Act:
(a) "Consumer products" means goods and services normally used
for personal, family or household purposes, the actual cash sales price
of which to the person guaranteed was in excess of ten dollars.
(b) "Services" means work, labor, or any other kind of activity
furnished or agreed to be furnished to a consumer including but
not limited to building and construction HOME IMPROVEMENT
services, the repair of automobiles, television sets and other similar
products, the repair or installment of plumbing, heating, electrical
or mechanical devices, the actual cash sales price of which to the
person guaranteed was in excess of ten dollars. However, nothing
herein shall apply to the professional services of accountants, archi-
tects, clergymen, lawyers and medical and dental practitioners.
(c) "Person guaranteed" means EITHER the first buyer at re-
tail of any consumer product to whom a guaranty is given or such
other person who is entitled to enforce against the guarantor the
obligations of the guaranty.
(d) "Guarantor" means any person, corporation, partnership or
association engaged in the business of making consumer products
available to consumers who gives MAKES a guaranty.
(e) "Guaranty" means:
(1) Any written affirmation of fact or written promise made at
the time of sale of consumer products by a guarantor to a person
