AN ACT to repeal Section 3-402.2 of Article 66½ of the Annotated
Code of Maryland (1970 Replacement Volume), title "Vehicle
Laws," subtitle "Certificates of Title and Registration of Vehi-
cles," and to enact new Section 3-402.2, in lieu thereof, to stand in
place of the section repealed, to provide that the Commissioner of
Motor Vehicles shall have the authority to enter into agreements
or arrangements with other jurisdictions for the purpose of es-
tablishing motor vehicle reciprocity, to provide for the conditions
under which agreements, arrangements and declarations shall be
made, to provide for the filing of such instruments, to require
that such instruments must be approved by the Governor, and
generally relating to the administration of motor vehicle reciproc-
ity as a contribution to the economic and social development of
this State.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 3-402.2 of Article 66½ of the Annotated Code of Mary-
land (1970 Replacement Volume), title "Vehicle Laws," subtitle
"Certificates of Title and Registration of Vehicles," be and is hereby
repealed, and that new Section 3-402.2 be and the same is hereby
enacted, in lieu thereof, to stand in place of the section so repealed,
and to read as follows:
[3-402.2. Reciprocal agreements as to nonresidents.
(a) The Governor of this State may confer and advise with the
proper officers and legislative bodies of other states and enter into
reciprocal agreements under which the registration of vehicles owned
by the residents of this State will be recognized by the other state;
and he is further authorized and empowered from time to time to
grant to residents of other states the privilege of using the highways
of this State as in this article provided in return for similar privileges
granted residents of this State by the other states.
(b) The Governor may enter into reciprocal agreements under
the authority of subsection (a) whereby vehicles which are owned
by residents, firms, or corporations of another state, and regis-
tered in the other state, but operated by residents of Maryland and
in the usual custody of the residents of Maryland, for an un-
limited period may be held and operated in such custody without
being registered in Maryland. Reciprocal agreements shall
be limited to situations in which the owner of the vehicle, and the
person, firm, or corporation in the name of which the vehicle is
registered, is an employer of the resident of Maryland having the
usual operation and custody of the vehicle. The reciprocal agreement
shall provide that before the vehicle shall be extended the privileges
of the agreement, the resident of Maryland having the usual opera-
tion and custody of the vehicle shall file with the Department a
statement showing the license number of the vehicle, the name and
address of the owner's place of business, and the name and address
of the resident of Maryland.
(c) Nothing in this section limits the provisions of Section
3-402.1.]
