BALTIMORE COUNTY

Bill No. 11

An Act, to adopt regulations governing the design, construction,
operation, and maintenance of public swimming pools and bathing
beaches within Baltimore County, and to provide penalties for viola-
tion of such regulations by adding Section 13-94 to the Baltimore
County Code, 1968, title "Health and Sanitation," under new Article
VIII, Public Swimming Pools and Bathing Beaches.

Whereas, the County Council of Baltimore County, Maryland, desires
to approve regulations adopted by the Baltimore County Department of
Health governing the design, construction, operation, and maintenance of
public swimming pools and bathing beaches in Baltimore County, in ac-
cordance with Title 13, Baltimore County Code, 1968, Section 5(j) of
Article 25A of the Annotated Code of Maryland, 1957, (1966 Replacement
Volume) and Section 48 of Article 43 of the Annotated Code of Maryland,
1957 (1965 Replacement Volume).

Section 1. BE IT ENACTED BY THE COUNTY COUNCIL OF
BALTIMORE COUNTY, MARYLAND, That, pursuant to the power and
authority contained in Article 11a of the Maryland Constitution, in the
Charter of Baltimore County, Maryland, in Title 13 of the Baltimore
County Code, 1968, in Section 5(j) of Article 25A of the Annotated Code
of Maryland 1957 (1966 Replacement Volume) and in Section 48 of Article
43 of the Annotated Code of Maryland, 1957 (1965 Replacement Volume)
a new section and a new article be and they are hereby added to the
Baltimore County Code, 1968, said section to be known as Section 13-94,
to be under the title "Health and Sanitation," Article VIII, "Public Swim-
ming Pools and Bathing Beaches," and to read as follows:

Article VIII. Public Swimming Pools and Bathing Beaches, Section
13-94. REGULATIONS GOVERNING THE DESIGN, CONSTRUCTION,
OPERATION, AND MAINTENANCE OF PUBLIC SWIMMING POOLS
AND BATHING BEACHES WITHIN BALTIMORE COUNTY.

(a) GENERAL PROVISIONS.

1. The following definitions shall apply in the interpretation and
enforcement of these regulations. The word "shall" as used herein in-
dicates a mandatory requirement.

1.1    Approving Authority. The Approving Authority shall be the
"Health Officer" of Baltimore County, or his duly authorized representa-
tive.

1.2    Department of Health shall mean Baltimore County Depart-
ment of Health.

1.3    Swimming Pool. Any artificial structure, basin, chamber or
tank containing a body of water for the primary purpose of swimming,
diving or recreational bathing.

1.4    Private Swimming Pool. Any swimming pool located on a
private residential property under the control of the homeowner, the use
of which is limited to members of his family and invited guests.

1.5    Public Swimming Pool. Any swimming pool, including private
clubs, other than a private residential swimming pool, intended to be used
collectively by numbers of persons for swimming or bathing operated by
