CHAPTER 11
(Senate Bill 25)

AN ACT to repeal and re-enact, with amendments, Section 1(15) of
Article 73B of the Annotated Code of Maryland (1967 1970
Replacement Volume), title "Pensions," subtitle "In General," to
change the method of determining the "average final compensation"
of the judges of the Municipal Court of Baltimore City.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 1(15) of Article 73B of the Annotated Code of Mary-
land (1967 197-0 Replacement Volume), title "Pensions," subtitle
"In General," be and it is hereby repealed and re-enacted, with
amendments, to read as follows:

(15) "Average final compensation" shall mean the average an-
nual earnable compensation of an employee for the five consecutive
years of service as an employee during which his earnable compensa-
tion was highest, or if he had less than five years of service, then
his average earnable compensation for his total service. The average
final compensation of the judges of the Municipal Court of Baltimore
City shall be based on the total salary received by them from both the
State and the City.

Beginning July 1, 1963, the provisions of this subsection shall apply
to members who retired prior to July 1, 1955 as well as to those who
retired on or after that date.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1971.

CHAPTER 12
(Senate Bill 42)

AN ACT to repeal and re-enact, with amendments, Section 67 of the
Code of Public Laws of Garrett County, (1957 Edition, being
Article 12 of the Code of Public Laws of Maryland), title "Garrett
County," subtitle "County Commissioners," as last amended by
Chapter 227 of the Acts of 1970, to provide for an increase in the
expense allowance paid the County Commissioners of Garrett
County , SUBJECT TO SUBSTANTIATION BY AN ITEMIZED
ACCOUNT OF EXPENSES, and to further make this increase
exclusive of salary.

Section 1. Be it enacted by the General Assembly of Maryland,
