Cumberland                                     2057

Article 23A of the Annotated Code of Maryland, entitled "Municipal
Corporations," as said Section was enacted by Chapter 423 of the Acts
of the General Assembly of Maryland, 1955, entitled "A RESOLUTION
TO AMEND SUBSECTION(b) OF SECTION 81 OF THE CHARTER
OF THE CITY OF CUMBERLAND (1966 EDITION), BEING ARTI-
CLE 1A OF THE CODE OF PUBLIC LOCAL LAWS OF MARY-
LAND, GIVING THE MAYOR AND CITY COUNCIL OF CUMBER-
LAND THE AUTHORITY TO LEVY AND COLLECT A TAX ON
THE ASSESSABLE PROPERTY OF SAID CITY FOR THE GEN-
ERAL PURPOSES OF SAID CORPORATION, NOT EXCEEDING
IN ANY ONE YEAR ONE DOLLAR AND FORTY CENTS ($1.40)
ON EACH ONE HUNDRED DOLLARS ($100) WORTH OF SAID
ASSESSABLE PROPERTY, AND IN ADDITION TO LEVY AND
COLLECT SUCH TAX AS MAY BE NECESSARY TO PAY THE
INTEREST AND PRINCIPAL PAYMENTS AS THE SAME AC-
CRUE AND MATURE ON THE BONDED INDEBTEDNESS OF
SAID CITY; PROVIDED, HOWEVER, THAT THE TOTAL
BONDED INDEBTEDNESS OF SAID CITY (EXCLUSIVE OF THE
INDEBTEDNESS OF THE WATER DEPARTMENT AND
SEWAGE DISPOSAL PLANT BONDS) SHALL NOT EXCEED AT
ANY ONE TIME TEN PERCENT (10%) OF THE ASSESSED
VALUATION OF THE PROPERTY IN SAID CITY."

Section 1. BE IT RESOLVED BY THE MAYOR AND CITY COUN-
CIL OF CUMBERLAND, That subsection (b) of Section 81 of the Charter
of the City of Cumberland (1966 Edition), being Article 1A of the Code
of Public Local Laws of Maryland, be and is hereby amended to read as
follows:

"(b) Levy, Indebtedness. Said Mayor and City Council of Cumber-
land shall have power to levy and collect a tax on the assessable property
of said city for the general purposes of said corporation, not exceeding in
any one year [one dollar and twenty-five cents] one dollar and forty cents
on each one hundred dollars worth of said assessable property; and in
addition, to levy and collect such a tax on the assessable property of said
city as may be necessary to pay the interest on all the outstanding city
bonds, and to provide a fund for the redemption and payment thereof at
maturity, provided, however, that the total bonded or floating indebted-
ness of said city (exclusive of the indebtedness of the Water Department
and Sewage Disposal Plant Bonds) shall not exceed at any one time ten
percent of the assessed valuation of the property in said city."

*** "(b)-(1) Said Mayor and City Council shall have the authority
to adopt, by appropriate Ordinances, a plan whereby those taxpayers who
are held to be under hardship by reason of limited income, age or other
reasons, may be granted relief from such taxation."

Section 2. AND BE IT FURTHER RESOLVED, That the date of
the passage of this Resolution is March 24, 1970, and the amendment of
the Charter of the City of Cumberland, hereby enacted, shall become
effective on May 13, 1970, unless a proper Petition for a Referendum hereon
shall be filed as provided by Section 13 of Article 23A of the Annotated
Code of Maryland, and provided a complete and exact copy of this Resolu-
tion shall be continuously posted on the North Centre Street entrance of
the City Hall, Cumberland, Maryland, until May 3, 1970, and provided
further that a fair summary of the proposed amendment shall be published
in the Cumberland Evening Times, a newspaper of general circulation in
the City of Cumberland, once in each of the weeks of March 23, 30, April
6, 13, 20, 1970.
