"It shall be the duty of the Board of Election Supervisors of Allegany
County to order an election to be held in the City of Cumberland on the
third Tuesday of [June, 1954] May, 1970, and in each fourth year
thereafter, at which elections the qualified voters of said city shall select a
Mayor and four Councilmen. In ordering said election, the said Board
shall determine the places in the City of Cumberland for holding such
elections, and the manner of holding the same shall be governed by the
laws of the State of Maryland governing general elections, except in the
matter of registration of voters, which shall be governed by the provisions
set forth in the subtitle 'Registration of Voters' hereinafter in this article,
and in the Ordinances of the Mayor and City Council now made or here-
after made in pursuance thereof, and in the matter of primaries, which
shall be conducted as herein provided.
"The said Board shall canvass the returns and declare the election
of the candidates receiving the highest number of votes, and shall report
the result of their canvass to the Mayor and City Council.
"The cost of said election shall be paid by the County Commissioners
of Allegany County, but shall be refunded to said County by the City of
Cumberland.
"The Mayor and each of said Councilmen shall qualify as required by
this Charter and the Constitution of the State within twenty days after
the official announcement of his election or appointment, as the case may
be, and in case of failure to do so, his office shall become vacant."
Section 2. AND BE IT FURTHER RESOLVED, That the date of
the passage of this Resolution is December 30, 1969, and the amendment
to the Charter of the City of Cumberland, hereby enacted, shall become
effective on February 18, 1970, unless a proper Petition for a Referendum
hereon shall be filed as provided by Section 13 of Article 23A of the
Annotated Code of Maryland, and provided a complete and exact copy of
this Resolution shall be continuously posted on the North Centre Street
entrance of the City Hall, Cumberland, Maryland, until February 8, 1970;
and provided further that a fair summary of the proposed amendments
shall be published in the Cumberland Evening Times, a newspaper of
general circulation in the City of Cumberland, once in each of the weeks of
December 29, 1969; January 5, 12, 19 and 26, 1970.
Section 3. AND BE IT FURTHER RESOLVED, That the Mayor
of the City of Cumberland is hereby specifically directed to carry out the
provisions of Section 2 hereof, regarding the giving of notice by posting
and publication of this Resolution approving the same, and, as evidence
of said compliance, the City Clerk shall cause to be affixed hereto a
certificate of publication of the newspaper in which the summary of this
Resolution shall have been published, and the Mayor, if there is no Petition
for a Referendum, shall declare the Charter Amendment made to be
effective on the effective date herein provided for, which is February 18,
1970, by affixing his signature hereto in the space provided below the
effective date hereof.
Section 4. AND BE IT FURTHER RESOLVED, That, if a proper
Petition for a Referendum on the Charter Amendment herein proposed is
filed, the Mayor and other proper officials of the City of Cumberland shall
comply with all of the provisions set forth in Sections 13 to 17, both
inclusive, of Article 23A of the Annotated Code of Maryland.
