LAWS OF MARYLAND 1971

MARYLAND, Sct:

At a Session of the General Assembly of Maryland, begun and held
in the City of Annapolis on the Thirteenth Day of January,
1971, and Ending on the Twelfth Day of April, 1971,
Marvin Mandel, being Governor of the State, the follow-
ing Laws were enacted, to wit:

CHAPTER 1
(House Bill 38)

AN ACT to repeal and re-enact, with amendments, Article 70, Section
1, of the Annotated Code of Maryland (1967 Replacement Volume,
1970 Supplement), title "Official Oaths," to provide the time, man-
ner and place when the Lieutenant Governor of Maryland shall
take his oath of office and to change the time when the Governor of
Maryland shall take his oath of office in order to make this section
conform to the provisions of Article II of the Constitution.

Section 1. Be it enacted by the General Assembly of Maryland,
That Article 70, Section 1, of the Annotated Code of Maryland (1967
Replacement Volume, 1970 Supplement), title "Official Oaths," be and
it is hereby repealed and re-enacted, with amendments, to read as
follows:

Section 1.

The Governor and the Lieutenant Governor shall take and subscribe
the oath prescribed by the Constitution on the [fourth] third Wednes-
day of January next ensuing his election or as soon thereafter as
may be practicable between the hours of twelve and two o'clock p.m.
in the Senate chamber before the Chief Judge of the Court of
Appeals, or in case of his sickness, absence or inability from any
other cause to attend, before one of the associate judges of said
court; and the said oaths shall be recorded in the test book of
the Court of Appeals.

Sec. 2. And be it further enacted, That this Act is hereby declared
to be an emergency measure and necessary for the immediate pres-
ervation of the public health and safety and having been passed by a
yea and nay vote supported by three-fifths of all the members elected
to each of the two Houses of the General Assembly, the same shall
take effect from the date of its passage.
